Declaration ^before^ Expressly Confesseth &c

             Therefore it is Considered by the Court here that the afd Jos: MccClester Recover ag.t
the afd John Sumers as well the sum of one thousand four hundred and fifteen pounds of tob.o
his Damages afd in forme afd Confessed as also the sum of three hundred and Ninteen pounds of
tob.o for his Costs and Charges by him about his suite in that part Expanded To the same Jos:
by the Court here of his assent adjudged and the afd Defendant in Mercy &.c

GD   Isaac Noble
     Command was given to the Sherr of Somersett County that he Should

take the Isaac Noble late of Somersett County Planter if he Should be found
                         in his bailywick and him Should safe Keep so that he might have his body
       before the Justices of his Lordships County Court of Somersett to be held at dividing Creek
       the third tuesday of march then next to answer unto Joseph MccClester in a plea of trespass
       upon the Case &c and that thereof he Should not fail &c

          And the afd Joseph MccClester by Leven Gale his attorney Proceeded against the
       afd Isaac Noble in the plea afd as followeth vizt

          Somersett fs   Isaac Noble Late of Somersett County planter was attached to answer
       Joseph MccClester of a plea of trespass upon the Case &c

          And whereupon the said Joseph by Levin Gale his attorney Complains that whereas the said
       Isaac the first day of November Anno Dom One thousand seven hundred and twenty six at
       Somersett County afd within the Jurisdiction of this Court was Indebted unto the said Jos:
       in One thousand two hundred and ninety seven pounds of tobacco as by an account hereunto
       annexed may appear and being so thereof Indebted the said Isaac in Consideration thereof
       the day and year afd at the place afd upon himselfe did assume and to the said Joseph then &
       there did faithfully promise that he the said Isaac the said one thousand seven two hundred
       and Ninety Seven pounds of Tob.o to the said Joseph when he should be thereunto
       requested he would well & faithfully pay & Content & altho' ye sd Isaac seven hundred &
       eighty two pd.s of Tob.o Pcell of the said Debt to ye sd Joseph he hath paid and
       Satisfied yett as to the residue thereof being five hundred & fifteen pd.s of Tobo
       the said Isaac his promise & assumption afd in forme afd made Nothing regarding
       but plotting and fraudulently Intending ye sd Joseph in yt part Craftilly &
       Subtilly to deceive & Defraud ye said five hundred & fifteen pd.s of Tob.o to the
       Said Joseph hath not paid altho' ye same to doe the said Isaac was often   
       thereunto Requested but the same to him hitherto to pay hath refused
       and Still doth refuse & Deny to the Damage of the said Joseph of
       one thousand and thirty pounds of Tob.o and thereupon he Brings
