Somersett fs      Peter Freney Late of Somersett County planter was attached to answer unto
                Joseph Macclester of a plea of trespass upon the Case &c

          And whereupon the said Jos by Levin Gale his attorney Complaines that whereas the said
Peter the first day of Novem Anno Dom one thousand seven hundred and twenty six at Somrsett
County within the Jur of this Court was Indebted unto the said Jos in Eight hundred & twenty
Eight pounds of tob.o as by acco hereunto annexed May in Court appear and being so thereof
Indebted the said Peter in Consideration thereof the day and year afd at the place afd upon
himselfe did assume and to the said Jos: then and there did faithfully promise that he ye said
Peter the said Eight hundred and twenty Eight pounds of tob.o to the said Jos when he should be
thereunto Requested he would well and faithfully pay and Content Nevertheless ye said Peter
tho' often Requested the said Eight hundred and twenty Eight pounds of tob.o to the said Jos: hath
Not paid but the same to him hitherto to pay hath Refused and Still doth Refuse & deny to
the damage of the said Joseph one thousand Seven hundred and fifty Six pounds of tobo
and thereof he Brings Suite &c                        L Gale P Quer pledges &c  J Doe Richd Roe

             A Copy of the foregoing declaration and acc.o were made and sent to be served on
       the afd Peter Freney with the writt in the plea afd &c

             Att which said third tuesday of March to wit the twenty first day of the same Month
       Anno Dom one thousand Seven hundred and twenty Six being the day of the Return of
       the said writt Cometh the afd Jos MccClester by his attorney afd and the sherr of Somersett
       County to whome the foregoing writt was Directed Likewise Cometh & Maketh Return thereof
       to the Court here Endorsed in these words ^following^ viz.t   Cepi Corpus Decl.n delivered in time p Fran Allen Sherr

                Whereupon the afd Peter Freney being Called appears and thereupon the afd Peter
       Freney at the prayer of the Plfts attorney afd Is adjudged to give Speciall Bail to the action
       afd whereupon a Certain Jn.o Caldwell late of Somersett County Gent present here in
       Court undertakes for the said Peter Freney that if in Case the afd Jos: MccClester Shall Recover
       Judgment in the plea afd against the afd Peter Freney or that the afd Peter Freney Shall be
       therein Convict that then ^he^ the ^said^ afd Peter Freney Shall pay the Condemnation of the Court
