for his Costs and Charges by him about his suite in that part Expended to the same Joseph by the Court here of

     Command was given to the Sher of somersett County that he should take
Abraham Ingram Late of Somrsett County Planter if he Should
be found in your his Bailywick & him should safe Keep so yt he
                   might have his body before ye Justices of his Lordships County Court of
Somrsett to be held at Dividing ^Creek^ the third tuesday of March then Next to answer unto
Joseph MaClester of a plea of Trespass upon the Case &c & that thereof he should
not fail &c      And the afd Jos MaClester by Levin Gale his attry Declared against
the afd Abraham ^Ingram^ in the plea afd as followeth vizt      Somrsett fs  Abraham
Ingram Late of Somrsett County Planter was attached to answer unto Jos: MaClester
of a plea of Trespass upon the Case &a      And whereupon the said Jos: by
Levin Gale his attry Complaines that whereas ye s.d Abraham the first day of
Novem.r Anno Dom one thousand Seven hundred & twenty Six at Somrsett
County afd within the Jur of this Court was Indebted unto ye ^said^ Joseph in one
thousand three hundred & Sixty Nine pd.s of Tob.o as by acct hereunto annexed
may appear & being so thereof Indebted the said Abraham in Consideration thereof
the day & year afd at ye place afd upon himselfe did assume & to the Said
Joseph then & there did faithfully promisse yt he ye said Abraham ye s.d one
thousand three hundred and Sixty Nine pd.s of Tob.o to the said Joseph when he
Should be thereunto requested he would well & faithfully pay & Content &
altho' the said Abraham one hundred & Sixty pd.s of Tobo Pcell of the s.d Debt
to the said Joseph he hath paid & Satisfied yett as to ye residue thereof being
one thousand two hundred & Nine pd.s of Tob.o ye S.d Abraham his promisse
& assumption afd in forme afd made Nothing regarding but plotting &
fraudulently Intending the said Joseph in yt part Craftilly & Subtilly to
Deceive & Defraud ye said one thousand two hundred & Nine pounds of
Tob.o to ye s.d Joseph hath not paid altho' ye same to doe the s.d Abraham was
often thereto requested but the same to him hitherto to pay hath refused & still
doth refuse & deny to ye Dam of ye s.d Jos of two thousand four hundred & Eighteen pd.s
of tob.o & thereupon he Brings Suite &c           L Gale P Quer pledges &c  Jno Doe Richd Roe
