       Att which said third tuesday of march to witt the Twenty first day of
the same Month Anno Dom one thousand seven hundred & twenty six
being the day of the return of the said Writt Cometh ye afd Joseph MccClester 
by his attry afd & the Sher of Somrsett County to whome ye foregoing writt
was Directed Likewise Cometh and Maketh return thereof to the
Court here Endorsed in these words vizt   Cepi Corpus decl.n  Delivered in time
                                                                                        P Fran Allen Sher

       And the afd Abraham Ingram by Geo Dashiell his attry Comes & Defends
the force & Injury when &c   and saith that he Cannot Deny the action
afd nor but that he did upon himselfe assume in Manner & forme as
the afd Joseph MccClester above against him supposed nor Can he deny
but that the afd Joseph hath Sustained Damages by occation of the
non performance of his promise and assumption afd to one thousand
and Eleven pounds of Tob.o and the same declaration before expressly
Confeseth &c                    Therefore it is Considered by the Court here
that the afd Joseph MccClester recover against the afd Abraham Ingram
as well the sum of one thousand and Eleven pounds of Tob.o his damages afd
in forme afd Confessed as also the sum of two hundred & Seventy one pds of
Tob.o for his Costs and Charges by him about his Suite in yt part Expended
To the same Joseph by ye Court here of his assent adjudged & the afd Deft
in Mercy &c

    John Sumers
    Command was given to the Sherr of Sommersett County that
he should Take Jno Sumers Late of Somersett County planter if he
should be found in his Bailywick and him should Safe keep so that he

       might have his Body before the Justices of ^his Lordships^ our County Court ^of Somersett^ to be held at Dividing Creek
       the third tuesday of March then next to answer unto Jos: MccClester of a plea of trespass upon
       the Case &c and that thereof he should not fail &c   And the said Jos MccClester by Levin
       Gale his attorney Declared against the said Jno Sumers in ye plea afd as followeth viz.t
       Somersett f  John Sumers Late of Somersett County planter was attached to answer unto Joseph
       MccClester of a plea of trespass upon the Case &c

                            And whereupon the said Jos: by Levin Gale his attorney Complaines y.t whereas
       the said Jn.o the first day of Novem Anno Dom one thousand seven hundred & twenty six
       at Somersett County afd within the Jurisdiction of this Court was Indebted unto the said Jos in
       one thousand five hundred and fifteen pounds of tob.o as by Acc.o hereunto annexed may
       appear and being so thereof Indebted the said Jn.o in Consideration thereof the day and year
       afd at the place afd upon himselfe did assume and to the said Jos then & there did faithfully
                                                                                                                         (promise)
