Hundred and seventy five pounds of tob.o the said Thomas his promise and assumption afd in form
afd made nothing Regarding but plotting and fraudulently Intending the said Jos in that part
Craftilly and Subtilly to Deceive and Defraud the said one thousand four hundred & seventy five
pounds of tob.o to the said Joseph hath not paid altho' the same to do the said Thomas was
often thereunto Requested but the same to him hitherto to Pay hath Refused and still doth
Refuse and Deny to the Damage of the said Joseph of two thousand Nine hundred and
fifty pounds of tobacco and thereupon he brings Suite &c      L Gale P Quer pledges &c J Doe

                   A Copy of the foregoing decl.n and Acc.o were made and sent to be served on the afd
             Tho.s with the writt in the plea afd &c

                      Att which said third tuesday of march next to wit the twenty first day of the same month
             Anno Dom one thousand Seven hundred and twenty Six being the day of the return of the
             said writt Cometh the afd Joseph MccClester by his attorney afd and the Sherr of Somersett
             County to whome the foregoing writt was Directed Likewise Cometh and maketh return thereof
             to the Court here Endorsed In these words viz.t Cepi Corpus decl.n Delivered in time p Fran Allen Sherr

                Whereupon the afd Thomas Gordan in his Own proper person Comes and defends
             the force and Injury when &c and saith that he Cannot deny the action afd nor Can he
             say but that the afd Joseph ought to recover his damages by occasion of the non performance
             of the promise and assumption afd to five hundred and fifty Nine pounds of tob.o and the
             same declaration in all the words before expressly Confeseth &c

                            Therefore it is Considered by the Court here that the afd Joseph MccClester Recover
             against the afd Thomas Gordan as well the sum of five hundred and fifty nine pounds of
