faithfully promise that he the said William the said one thousand three hundred & one pounds of tob.o
to the said Joseph when he should be there unto Requested he would well and faithfully pay & Content &
altho' the said William three hundred and Sixty four pounds of tob.o percel of the said debt to the said
Joseph he hath paid and Satisfied yett as to the Residue thereof being Nine hundred & thirty Seven pd.s
of tob.o the said Will.m his promise and assumption afd informe afd made Nothing regarding but
plotting and fraudulently Intending the said Joseph in that part Craftilly and Subtilly to deceive &
Defraud the said Nine hundred and thirty Seven pounds of tobacco to the said Joseph hath not paid
altho' the same ^to^ do the said William was often thereto Requested but the same to him hitherto to pay
hath Refused and Still doth Refuse and deny to the damage of the said Joseph of one thousand
Eight hundred and Seventy four pounds of tob.o and thereupon he Brings this Suite &c

       Whereupon the afd William Twyfoott present here in Court in his proper person
is at the prayer of the Plfts attorney afd adjudged to give Speciall Bail to the Action afd thereupon
a Certain John Harper of Somersett County Planter present here in Court undertakes for the said
William Twyfoott that in Case the said Joseph MccClester Shall recover Judgm.t in the plea afd
against the afd Will.m Twyfoott or that the said William Twyford Shall be therein Convict that
then he the said Will.m Twyfoott Shall pay the Condemnation of the Court thereupon or render
his Body to the Costody of the sherr of Somersett County in Satisfaction thereof or that he the
said John Harper will do it for him

                            And the afd William Twyfoot by George Dashiell his attorney Comes and
defends the force and Injury when &c and says that he Cannot deny but that he ^did^ assumed upon
himselfe in manner and form as the afd Joseph above against him declared nor but he owes the
afd Joseph seven hundred and fourteen pounds of Tobacco part of the afd Sum Sued for; which the
afd Plft doth not gainsay &c
                                                                Therefore it is Considered by the Court here that the
afd Joseph MccClester Recover against the afd W.m Twyfoot as well the sum of seven hundred and
forty one ^fourteen^ pounds of tob.o his damages afd in form afd Confessed as also the sum of three hundred
