        and twelve pounds of tobacco for his Costs and Charges by him about his Suite in that part

 Command was given to the Sherr of Somersett County that he Should
take William Brereton late of Somersett County planter if he should
be found in his bailywick and him should safe keep so that he might
       have his body before the Justices of his Lordships County Court of Somersett to be held at
       dividing Creek the third tuesday of march then next to answer unto Joseph McClester of
       a plea of trespass upon the Case &c  and that thereof he should not fail &c

                   And the afd Jos: by Leven Gale his attorney declared against the afd William in
       the Plea afd as followeth vizt   Somrsett fs   Will.m Brereton Late of Somrsett County
       Planter was attached to answer unto Jos: McClester of a plea of Trespass upon
       the Case &c   And whereupon the said Jos by Levin Gale his attry Complaines
       that whereas the said Will.m the first day of Novem Anno Dom one thousand
       Seven hundred and twenty Six at Somrsett County afd within ye Jurisdiction
       of this Court was Indebted unto the said Joseph in one thousand one hundred
       and thirty six pounds of Tob.o as by acc.o hereunto annexed may appear &
       being so thereof Indebted ye s.d Will.m in Consideration thereof the day & year
       afd at the place afd upon himselfe did assume and to the s.d Joseph then and
       there did faithfully promise yt he the s.d W.m one thousand one hundred &
       thirty Six pounds of Tob.o to the s.d Joseph when he should be there unto
       requested he would well and faithfully pay & Content & altho' the s.d Will.m three
       hundred & forty Eight pd.s of Tob.o pcell of the s.d Debt to the s.d Joseph he
       hath paid & Satisfied Yett as to ye residue thereof being Seven hundred &
       Eighty Eight pd.s of Tob.o ye s.d Will.m his promise & assumption afd in
       forme afd made Nothing regarding but plotting & fraudulently Intending
       the said Joseph in yt part Craftilly & Subtilly to Deceive & Defraud the s.d
       Seven hundred & Eighty Eight pd.s of Tob.o to the said Joseph hath not paid
       altho' the same to doe the s.d Will.m was often thereunto requested but ye same
       to him hitherto to pay hath refused & Still doth refuse & deny to ye Damage
       of ye s.d Joseph of one thousand five hundred & Seventy Six pd.s of Tob.o and thereupon
       he Brings Suite &c                                            L Gale P Quer pledges &c J Doe R Roe
