March Court
1726 225 have Received Whereupon the afd James hath Supplicated us for a proper remedy in that part to him to be provided and because we are Willing that those things which in our s.d County Court are Rightfully Done Should Come to a due Execution we Command you yt by good & Lawfull men of your Bailywick you make Known unto the afd John Denston that he be and appear before the Justices of our County Court to be held at Dividing Creek the third tuesday of March Next to Shew Cause if anything for himselfe he hath or to Say Knoweth wherefore the afd James Caldwell his Execution against him of the Damages and Costs afd to have ought not according to the form force and Effect of the recovery afd if unto him it Shall Seem Expedent and have you then & there the Names of those before whom you make The same Known and this writt wittness &c Att which said said third tuesday of March to witt the twenty first day of the same Month Anno Dom one thousand Seven hundred and twenty Six Being the day of the return of the said Writt Cometh the afd James Caldwell by his attry afd and the Sher of Somrsett County to whome the foregoing writt was Directed Likewise Cometh and Maketh return thereof to the Court here Endorsed in these words vizt Made Known Fran Allen Sher And the afd John Denston altho' so to answer being Solemnly Called Cometh not but makes default &.c Therefore it is Considered by the Court here that the afd James Caldwell have his Execution against the afd John Denston as well for the Sume of Eight hundred and twenty five pounds of tob.o his damages afd as also the Sume of two hundred and fifty pounds of tob.o to the ^afd James by the Same Court were adjudged according to ye form of ye Statute for^ Damages and Costs and Charges sustained by occasion of Delay of Execution of the Damages afd &c
whereas the said William the first day of Novem Ann Dom one thousand Seven hundred and twenty Six at Somersett County afd within the Jur of this Court was Indebted unto the said Joseph in one thousand three hundred and one pounds of tobo as by acc.o hereunto annexed may appear and being so thereof Indebted the said William in Consideration thereof the day and year afd at the place afd upon himselfe did assume and to the said Joseph then & there did (faithfully) |
