224 attorney Comes and Says that he Cannot gainsay but that he has of the Rights and Creditts of the afd Jn.o Hope to the value of thirty Shillings nor Can he say but that the same ought to be Condemned in his hands for the use of the said George Dashiell as of the Rights and Creditts of the said John Hope which the said Plft doth not gainsay Whereupon the said George Dashiell prays that upon giveing Security according to act of assembly the afd Sum of thirty Shilling so as afd Confessed by the afd William Miles as of the Rights and Creditts of the afd John Hope may be Condemned in the hands of the said William Miles towards Satisfying of them his damages and Costs &c thereupon Leven Gale of Somersett County Gent Present herein Court undertakes for the said George Dashiell according to act of assembly that in Case the said John Hope shall at any time within a year and a day appear and make all or any Part of the said George Dashiell Claim against him to be satisfyed or otherwise to have been undue before the Laying of this attachmt that then the said George Dashiell shall make Restitution unto him the said John Hope of all or such part thereof as shall be made appear to be undue &c or that he the said Levin Gale will do it for him Therefore it is Considered by the Justices here that the afd sum of thirty shillings so as afd Confessed be Condemned in the hands of the afd William Miles as of the Rights and Creditts of the afd John Hope towards satisfying unto the said George Dashiell his damages and Costs &c and that the said George Dashiell have thereof his Ex.n according to act of assembly &c
of Somersett County Greeting Whereas James Caldwell Lately in our County Court of Somrsett here (to witt) on the Seventeenth day of March Anno Dom One thousand Seven hundred and twenty four before the Worshipfull Samuel Hopkins Gent and his associates then Justices of our Same Court (at Dividing Creek) and by Consideration of the same Court recovered against a Certaine John Denston Late of Somrsett County Planter Eight hundred and twenty five pounds of Tob.o for his Damages which he Sustained as well by occasion of the Nonperformance of a Certain Promisse to the same James by the afd John made as for his Costs and Charges by him about his Suite in yt part Expended whereof he is Convict as by the records and Process thereof in the Same Court before us remaining Manifestly appeareth and altho' Judgmt be thereupon rendered Nevertheless Execution of the Damages and Costs afd as yett remaineth to be Done as by the Ininuation of the afd James we (have) |
