223 Currant money and six hundred pd.s tob.o & when you have the same attached or any part thereof the same in your Custody safe Keep so yt you have the same before the Justices of our County Court to be held at Dividing Creek in Somrsett County afd the third tuesday of March next then & there to be Condemned according to act of assembly to and for the use of a Certain Aaron Linn unless the said Asser Sharpe by himselfe or his attry shall appear and answer unto the said Aaron Linn in a plea of Trespass upon the Case &a according to Law and y.t by good & Lawfull men of your Bailywick you make Known unto ye person or persons in whose hands you make ye same attachm.t yt he she or they be & appear before ye Justices of our said County Court to be held as afd to Shew Cause if any he She or they have why the same goods or Chattles rights or Creditts so attached in his her or their hands ought not to be Condemned & Execution thereof had & made according to ye forme of ye act of assembly in such Case made & provided if to him her or them it Shall seem mete & how you Shall Execute this Writt yt you Make Known unto our S.d Justices at ye same day & place afd & have you then & there this Writt Wittness &c Att which said third tuesday of march to witt the twenty first day of the same month ann.o Dom One thousand Seven hundred and twenty Six being the day of the return of the said Writt Cometh the afd Aaron Linn by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words vizt By vertue of the within writt to me directed to the I have attached to the value of Twenty pounds Curr.t mony and Six hundred pounds of tobacco in the hands of Isaac Handy and have Sumoned him as garnishee to appear &.c to Shew Cause &.c as by the within writt I am Commanded before John Doe and Richard Roe good and Lawfull men of my bailywick so answers Fran Allen sherr Whereupon the afd Isaac Handy Garnishee as afd by George Dashiell his attorney Comes and Saith that he Cannot gainsay but that he has of the Rights and Creditts of the afd Asser Sharpe to the value of Eighteen pounds Curr.t mony and Six hundred pounds of tobacco nor but that the Same Ought to be Condemned in his hands for the use of the said Aaron Linn as of the rights and Creditts of the afd Asser Sharpe which the said Plft doth not gainsay Whereupon the afd Aaron Linn by his attorney afd prays that the afd sum's so as afd Confessed by the afd Isaac Handy as of the Rights and Creditts of the said Asser Sharpe ^may be condemned^ in the hands of the afd Isaac Handy towards satisfying unto the said Aaron Linn his damages & Costs &c Therefore it is Considered by the Justices here that the afd sum of Eighteen pounds Curr.t mony and Six hundred pounds of tobo so as afd Confessed be Condemned in the hands of the afd Isaac Handy as of the Rights and Creditts of the afd Asser Sharp towards satisfying |
