    March Court            1726                 223

Custody of the Sherr of Somersett County in Satisfaction thereof or that he the said Mathew
Purnall will do it for him &c

       Whereupon the afd John Timmons in his proper persons Comes and defends the
force and Injury when &.c and saith that he Cannot gainsay but that he assumed upon himselfe
in manner and form as the afd plft above against him declared nor but he oweth
the afd Plft the afd four hundred and Eight pounds of tobo and the same declaration in all the
words before Expressly Confeseth
                                                                   Therefore it is Considered by the Justices
here that the afd Joseph McClester Recover against the afd John Timmons as well the Sum of
four hundred and Eight pounds of tobo his damages afd above in the declaration afd Specifyed
as also the sum of three hundred and Seven pounds of tobo for his Costs and Charges by him
about his Suite in that part Expended to the same Joseph by the Court hereof his assent adjudged
and the afd deft in mercy &c

      This being an action of trespass upon the Case &.c wherein the Sher
of Somersett County to whom the writt in the same action Cometh and
maketh Return thereof to the Court here Endorsed in these words vizt
                                                                                  Cepi Corpus P Fran Allen sherr

          Whereupon the afd William Freeman being Present here in Court is at the prayer
    of the Plfts attorney afd adjudged to give Speciall Bail to the action afd   Thereupon
    a Certain John Onorton of Somersett County ^Planter^ present here in Court undertakes for the said
    William Freeman that if in Case the afd Alexander Mercy shall recover Judgment in the
    plea afd against the afd William Freeman or that the afd W.m Freeman Shall be there in Convict
    that then he the the said Will.m Freeman Shall pay the Condemnation of the Court
    thereupon or render his Body to the Costody of the Sherr of Somersett County in Satisfaction
    thereof or that he the said John Onorton will do it for him &c

          Whereupon the afd William Freeman in his proper person ^appears^ and Imparles till
    next Court &c

writt of attachment against the deft the tenor whereof followeth in thes words
following viz.t     Somrsett fs    Charles absolute Lord & proprietary
of the provinces of Maryland & avalon Lord Baron of Baltemore
                         &c   To ye Sher of Somrsett Co.ty Greeting we Command you y.t you attach
       any the goods Chattles rights or Creditts of asser Sharpe Late of Somrsett County
       Gent if they Shall be found in your Bailywick to ye value of Twenty pds
