hereafter acquitt and safe harmless the Inhabitants of Somersett County for the time being of and from
all Costs Charges and troubles whatsoever for or by reason of the birth nourishment maintenance and
bringing up of the afd Child and of and from all other suites Charges troubles and demands whatsoever
touching or Concerning the Same then the above recognizance to be void otherwise &c

Somersett fs John Timmons Late of Somersett County planter was attached
to answer unto Jos: M^aClester of a plea of Trespass upon y^e Case &^c
And whereupon the Same Jos: M^aClester by Levin Gale his

attorney Complaines that whereas the afd John y^e tenth day of Decem
Seventeen hundred & twenty five at Som^rsett County within y^e Jur of this
Court was Indebted to y^e afd Joseph in y^e Sum of four hundred & eight p^ds
of Tob.^o as by acc.^t here within Court produced may appear & so thereof bein
being Indebted the s.^d John in Consideration thereof afterwards to witt the
Same day & year afd at the County afd within the Jurisdiction of this Court
upon himselfe assumed and to the said Jos: then & there faithfully promissed
that he when afterwards he Should be there to requested he y^e s.^d
Sum of four hundred and eight pounds of tob.^o to y^e Same Joseph wou'd
well and faithfully Content & pay Nevertheless the said John his promisse
and assumption afd in form afd made Little regarding & plotting and fraudulently
Intending the same Joseph in that part Craftilly & Subtilly to
Defraud and deceive he y^e s.^d Sum of four hundred and eight pounds of Tob.^o
or any part thereof to y^e Same Joseph (although the afd John afterwards
to witt y^e Same day & year ^afd^ Last Mentioned & often afterwards at Som^rsett
County afd within the Jur afd by the Same Joseph was requested hath
not paid or him for it in anywise Contented but he y^e John the same
heitherto to doe hath altogether refused & still doth refuse & do upon
whereby the Same Joseph Says he is worse & hath Damage to y^e
value of three thousand pounds of Tob.^o & thereof he Brings this suite

Whereupon the afd John TImmons being present here in Court in his proper person is at the
prayer of the plfts attorney afd adjudged to give speciall bail to the action afd thereupon a Certain
Mathew Purnall of Somersett County Planter present herein Court undertakes for the said John
Timmons that if in Case the afd Joseph M^ccClester Shall Recover Judgm.^t in the plea afd against y^e
afd John Timmons or that the afd John Timmons shall be therein Convict that then he the said
John Timmons shall pay the Condemnation of the Court thereupon or Render his body to the
Custody
