Dashiell who for his Lordship Prosecutes and gives the Court to understand and being formed that a Certain Francis Brooks Late of Somersett County Cordwaner on the day of Ann Dom one thousand Seven hundred Twenty Six did Committ fornication with a Certain Mercy Stevens and on her Body did begitt a bastard Child against the pecie of the Lord proprietary of this province and against the forme of an Act of assembly of this province in Such Case made and Provided Dashiell prosecutor Thereupon a Command was given to the Sherr of Somersett County that he Should take the afd Francis Brook's if &c to answer &c And afterwards in the same Court Came the afd Francis Brooks and being by the Sherr sett to the bar is thereupon Immediately demanded how he would acquitt himselfe of the Premisses afd says that of the Premisses afd he is guilty thereof and prays that he may be admitted to make fine to his said Lordship for the fact afd and thereof puts himselfe in mercy of the said Lord proprietary Wherefore it is Considered by the Court that the afd Francis Brooks be fined to his said Lordship the Lord Proprietary thirty shillings for the fact afd and that the afd Francis Brooks be taken &c whereupon It is ordered by the Court that the afd Francis Brooks give security for the fine afd and all the officers their fees due by occasion of the premises afd thereupon a Certain W.m Booth of the County afd present in Court pays thirty Shill.s for the said Francis Brooks for the fine afd and undertakes for to pay the Severall Officers their fees dues by means of the Premisses afd Likewise it is ordered by the Court that the afd Francis Brooks give good security to save and keep Endempnifyed somersett County from all Costs Charges and troubles whatsoever for or by reason of the birth Nourishm.t and bringing up of the Child so as afd begott of the afd Marcy Stevens Whereupon the afd Francis Brooks together with the afd William Booth his security both present in Court in their proper persons acknowledged themselves to owe and Stand Justly Indebted unto the Inhabitants of Somersett County in the Sum of twenty pounds sterling good and Lawfull mony of England on their bodys goods or Chattells Lands or tenements Joyntly and Severally to be made and Levied for the use of Somersett County afd if it happen the afd Francis Brooks fail in the Condition under written The Condition of the above recognizance is such that if the above bounden Francis Brook's his heirs Exrs and adm.rs or any of them do and shall from time to time and at all times hereafter |
