       March Court       1726            221

fail in the Condition here under written      The Condition of the above Recognizance is such
that if the above bounden William Brasher his heirs Executors or admrs do and shall well &
truely pay or Cause to be paid unto the abovesaid James Mumford Brasher his heirs or assignes
the full and Juste Sum of thirty four pounds Eleven Shillings and ten pence or the value
thereof according to Law appraisment and will of the said Richard Wharton when he
shall arrive to full age to receive the same &c then the above Recognizance to be void &c
otherwise &c

John Smith, Mary Smith and Eliza Smith
Whereas the Commisary's Gen.lls have transmitted
to the Justices of Somersett County Court the
Ball of the Estate of Charles Smith dec.d
wherein it is found that a Certain John Phillips
                            was ye adm.rs of the Same Estate &c         Thereupon ye afd Jn.o Phillips
                            present here in Court is ordered to give security according to Law &c
       Whereupon the afd John Phillips together with James Bowcher Wm
       Twyfoott Abraham Ingram & Rich.d Jefferson all of Somrsett County Planters
       present in Court in their proper Persons acknowledged themselves to owe &
       Stand Justly Indebted unto John Smith, Mary Smith, and Eliza Smith in
       the full & Just Sum of Ninety Nine pounds ten Shills & Eight pence Currt
       money of maryland Joyntly & Severally upon their bodys goods & Chattles
       Lands & tenements to be made & Levied for the use of the said
       John Smith Mary Smith & Eliz.a Smith their heirs or assignes   if it
       happen the afd John Phillips fail in ye Condition here under Written
      
                The Condition of the above recognizance is such that if the
       above bounden John Phillips his heirs Executors or adm.rs do & shall
       well & truely pay or Cause to be paid unto the abovesaid John Smith
       Mary Smith & Eliz.a Smith their heirs or assignes the full & Just
       Sum of Forty Nine p.ds fifteen Shills & four pence in Equall parts or
       Portions or the value thereof according to Law & appraisment when they
       Shall arrive to full age to receive the same &c   then the above recognizance
       to be void otherwise &c

       Whereas a Certain Mary Wilkerson a servant To Thomas Dashiell of Somersett County Gent
       Comes into Court and prays that She may be discharged from an Indenture by which the said
       Thos Dashiell detains her as a Servant by &c   The afd Thomas Dashiell being present here
       in Court   And the Indenture being produced herein Court and their severall ag allegations
       as well on the Part of the afd Complainant as on the part of the afd Thomas Dashiell
