21 seventeen hundred & twenty four at the Parish afd in the County afd within the Jurisdiction of this Court in and upon a Certain Mathew Kinnington in the peace of God & the said Lord proprietary then & there being with force and armes an assault made and him the said Mathew then and there beat wounded and Evilly treated so that of his Life it was despaired and other harmes to him then and there did doe to the great damage of the said Mathew and against the peace of our Said Lord proprietary his good rule and Government &c L Gale Cl Indictmts Test Mathew Kinningham, Robert Collier, and Nehemiah Nicholson Sen.r On the Backside of the foregoeing bill of Indictm.t it was thus Endorsed viz.t Billa Vera John Scarbrough foreman Thereupon Command is Given to the Sherr of Somersett County that he should take the afd Richard Tiler Late of Stepney parish in the County afd Planter and Benjamin Esome Late of the same Parish and County Planter if they shall be found &c to answer &c And afterwards in the same Court to witt the fifteenth day of June Come the said Richard Tiler and Benjamin Esom in Custody of the Sherr into whose Custody before that time was Committed for the Cause afd and the said Richard Tiler and Benjamin Esom being by the said Sherr put to the Barr the said Richard Tiler is thereupon Instantly demanded how he would acquitt himselfe of the premisses afd above Imposed upon him says that of the premisses afd above upon him Imposed he is not Guilty thereof and thereof for tryall puts himselfe upon the Country and Levin Gale who for his said Lordship in this Behalfe prosecutes Likewise Also the said Benjamin Esom being demanded how he would acquitt himself of the premisses afd says that he is Guilty thereof and putts himselfe in Mercy of the Lord proprietary and prays that he may be admitted to make fine to the Lord proprietary for the fact afd Whereupon the afd Richard Tiler Relinquisheth his verification afd by him afd above pleaded and says that he is guilty of the premises afd above upon him Imposed and putts himselfe in mercy of the Lord proprietary and prays that he may be admitted to make fine to the Lord proprietary for the fact afd Wherefore it is Considered by the Justices here the Same day & year afd that the said Richard Tiler and Benjamin Esome be fined to the said Lord proprietary the Sum of Eight hundred pounds of tobo Each for the fact afd and ordered that they Give security for the payment of the fine afd and all the Officers their fees due by occasion of the premisses but for want thereof the Said Richard Tiler and Benjamin Esom are Committed into Custody of the Sherr of Somersett County there to remain &c the Said Sherr present herein Court tooke Charge of the Said Richard Tiler & Benj.a Esom accordingly also the Said Benj.a Esome and richard Tiler are Ordered by the Court to give Recognizance for their good behaviour and appearance at next Court Thereupon the said Richard Tiler with Abraham Cordery and Robert Givans ^his securitys^ all present in Court acknowledged themselves to Owe (and) |
