on the Holy Evangelist of almighty God according to act of assembly in such
Case made & provided) & there Cause to Come before you or any three or
two of you all Such Evidences as Shall be to you or any three or two of
you Nominated by the Said Complainant (or Deft if any) & that you Examine
them upon their Corporall Oaths to be by you or any three or
two of you adminstred on ye Holy Evangelist of almighty God in the
presence of the Complainant (or Deft if any) touching ye truth or remembrances
of their Knowledge or anything that may relate to ye Cause afd
& yt reduceing ye Severall Depositions into Writing you send ye Same together
with this our Commission under your or any three or two of your
hands to us to our County Court of Somersett with all Conveniant Speed
Wittness Samuel Hopkins Gent Chief Justice of our s.d County ye 19th day of
Novem.r in ye 11.th year of our Dominion &c    Anno Dom 1726

       On the Backside of the foregoing Commission it was thus Endorst vizt
       Then Came before me M.r Ebenezer Hand & M.r Jn.o Roach & Mr John
Disherun & was qualified to Execute ye within Commission according
to Law as Wittness my hand this 24th day of Decemr 1726         Jn.o Caldwell

                                                These are to Satisfie that we ye Subscribers by
Court to Examine Evidence to the Bounders of a Certain tract of Land now
in the possession of John Magee at whose petition ye s.d Commission Issued
Bareing Date ye 19.th day of Novemr 1726 according to an act of assembly
of ye s.d province we did Set up our Notes under our hands at Stepney
Parish Church & Chappell & Andrew Bushawes Water mill Dated ye
24th day of December Last past there by giveing Notice according to Law
& we appointed to meett on the S.d Land ye 28.th day of this Instant Janry
& then & there did Com upon ye s.d Land & Noe Contending person
appearing nor any yt we Could hear of to appeare

       Phenex Hall Sen.r aged about 80 years & Will.m Hayman aged about
50 years they being by us sumonsed for Evidences ye s.d Hall Carried us
to a marked white oak Standing on ye North side of ye South East Branch
of Rockawaken river a Little belowe a fork in ye Branch that Makes
Davisses Neck which ye s.d Hall Laid his hand on ye s.d white oak & Swore
on the Holy Evangelist of almighty God y.t Tho.s Cox whoe is now Dec.d
told him in his Life time yt he Markt ye afd white oak standing as afd
for ye first Bounder of a tract of Land taken up by Cornelias Johnson
Containing 300 acres Called Coxes Choyce which is now in the Possession
of Jn.o Magee, Will.m Hayman being sworn on the Holy Evangelist
of almighty god Laid his hand on the afd white oak & said that
