1726 216 Some time & place as to you or any three or two of you shall Seem Convenient you meet on ye afd Lands Called Partners Choyce (you first haveing taken your Oath on ye holy Evangelist of almighty god according to act of assembly in Such Case made & provided) & there Cause to Come before you or any three or two of you all such Evidences as Shall be to you or any three or two of you Nominated by ye s.d Complainants (or Defts if any) & yt you Examine them upon their Corporall Oaths to be by you or any three or two of you administred on ye Holy Evangelist of almighty god in ye presents of the Complainents (or Defts if any) touching the truth or rememberances of their Knowledge or anything that may relate to ye Cause afd & yt reduceing the Severall Depositions into Writing you send the same together with this our Commission under your or any three or two of your hands to us to our County Court of Somrsett with all Convenient Speed Wittness Sam.ll Hopkins Gent Chief Justice of our s.d Court ye 19.th day of Novem.r in the 11.th year of our Dominion &c Anno Dom 1726 (p order) Tho.s Hayward Cl On the Backside of ye foregoing Commission it was thus Endorst viz.t Dec.r the 19.th 1726 Then Came before me the Subscriber one of his Lordships Justices for Somrsett County John Scott & Jn.o Donelson and made Oath on ye holy Evangelist of almighty god to Execute ye within Commission as ye Law Directs Sworn before me Samuel Hopkins Somrsett Coty ss By virtue of of a Commission Directed to Francis Allen John Scott, Jn.o Donelson & Thomas Peall to Examine Evidences on Behalfe of a Certaine Jn.o Dennis Will.m Silby Samuel Brittingham Parker Silby and Will.m Hopkins in Relation to the Boundaries of a Certain tract of Land Lying in the Indian Town on Pocomoke River &c We viz.t John Scott & Jno Donelson two of the afd Commissioners being qualified as the Law Directs & haveing given timely Notice mett on the afd Land the 17.th of July 1726/7 & took ye following Depositions The Deposition of James Mumford aged near 53 years being duly Sworn Sayeth that about years since he ye s.d Depon.t was Serv.t to a Certaine John Emett & that ye s.d Emmett told this Depon.t yt the Last bownder of Whites Land stood over Deep branch Near ye Mouth of the said Branch & Near the head of the Pocomoke River; & yt he heard the afd Emmett tell Capt W.m Round yt he ye Said Emmett was at ye takeing up of Whites Land & further saith Not The Deposition of George Truitt of Coponia aged about 55 being duly Sworn Sayeth that George Truitt Sen.r told him ye s.d Depon.t (we being then by a Corner tree Near the Mouth of ye afd Deep Branche on the N: E Side of it) that Near that place where the afd Corner tree stood was abounder of whites Land & some time after he the said Depon.t was shewed this (tree) |
