214 and that at your County Courts you make Inquisition and hear and Determine as afd doing therein what to Justice appeartains according to ye Laws & Customs of ye Kingdom & province afd & further we do Constitute ordain & appoint you ye s.d Sam.ll Hopkins, W.m Planner, Jn.o Jones, W.m Fausit, Jn.o Smith, W.m Stoughton Jn.o Caldwell, Jn.o MaClester Jn.o Handy James Dashiell, Jn.o Scott & Rob.t King or any three or more of you as afd to Issue out Writts Precepts Process & attachments and hold plea of Oyer and Terminer of all Actions popular & upon ye Statute and of all actions personall of what sort soever wherein ye Demand do doth not Exceed ye Sum of one hundred pd.s Sterling or thirty thousand pd.s of Tob.o & all Actions Personall now Depending before you be ye Demand how great soever and after Judgment Execution to award in all Such Causes & actions as afd according to ye Laws Orders & Customs of that part of ye Kingdom of Great Brittan Called England as of this our province of maryland in which S.d Actions so to be tryed we do Constitute ordain & appoint you ye s.d Sam.ll Hopkins, W.m Planner Jn.o Jones, W.m Fausitt, Jn.o Smith, W.m Stoughton, Jno Caldwell, Jn.o MaClester Jn.o Handy, James Dashiell, Jn.o Scott & Rob.t King and none others to be Judges also by these presents we do Command ye Sheriffe of or said County of Somrsett yt at ye Severall Courts to be held for our Said County he give his attendance and Cause to Come before you or any three or more of you as afd such & so many good & Lawfull men of his Bailywick out of Each & Every hundred thereof by whom ye truth of ye Matter in ye premises may be ye better Known and Enquired of Lastly you Shall Cause to be brought before you at your said Courts all Writts precepts processe and Indictments to your Courts and Jurisdiction belonging yt the same may be Inspected & by Due Course of law Determine Wittnesseth our trusty & wellbeloved Charles Calvert Esqr our Captaine Generall & Lieutenant Governour in & over this our province of maryland this 28.th day of Febry in the 12.th Year of our Dominion &c Annoq.r Dom 1726 Charles Calvert On ye Backside of ye foregoing Commission it was thus Endorsed vizt Maryland fs Charles absolute Lord & proprietary of ye province of maryland & avalon L.d baron of Baltemore &c To W.m Planner, Jn.o Jones, W.m Fausitt, Jn.o Smith, Will.m Stoughton, Jn.o Caldwell & Jn.o MaClester of Somrsett County Gent Greeting we do hereby Authorize & Impower you or Either of you to administer the severall Oaths appointed by act of assembly as also ye Oaths of Justice to Sam.ll Hopkins Jno Handy, James Dashiell, Jn.o Scott, & Rob.t King of ye same County Gent or any of them & you ye s.d Sam.ll Hopkins, Jn.o Handy, Ja.s Dashiell, Jn.o Scott and Rob.t King or any of you haveing taken ye s.d Oaths are hereby Impowered to administer ye Same to ye Justices & Commissioners respectively as they are Nominated in ye within Comission & we will that you & every of you haveing taken ye s.d Oaths do Severally Subscribe ye Test & oaths of abjuration and |
