213 William in Consideration thereof the day and year afd at the place afd upon himselfe did assume & to the said Andrew then and there did faithfully promise that he the said William y.e said five hundred pd.s ^of^ tob.o to the said Andrew when he should be thereunto requested he would well and faithfully pray & Content Nevertheless the said William tho' often requested the said five hundred pounds of tob.o to the said Andrew hath not paid but the same to him hitherto to doe pay hath refused and still doth refuse & deny to the Damage of the said Andrew of one thousand pds of tob.o & thereof he brings this Suite &c L Gale P Quer pledges & Jno Doe R Roe
August ye 9.th day 1726 Then Came M.r Andrew Wailes and made Oath on the holy Evangelist of Almighty God that the above acco.t is Just sworn to before me Wm Planner And the afd William West in his Own proper person Cometh and defendeth the force and Injury when &.c and saith that he Cannot gainsay but that he did promise and upon himselfe assume in manner and form as the afd Andrew Wailes be declaring afd above supposed and the same declaration in all the words before Expressly Confesseth Therefore it is Considered that the afd Andrew Wailes Recover against the afd William West the Sum of five hundred pounds of tobo his damages afd above in the declaration afd specified as also the Sum of two hundred & sixty 269 Nine pounds of tobo for his Costs and Charges by him about his suite in that Part Expended to the same And.w by the Court here of his assent adjudged and the afd deft in mercy &c The Court adjourns till the third tuesday of March 1726 |
