memorandm W.m Ennis by Levin Gale his attorney but his Lordships writt of sire facias
against the deft the tenor whereof followeth in thes words vizt
Charles absolute Lord and proprietary of the provinces of maryland &.c  To the Sherr of
             Somersett County Greeting we Command you that of the goods and Chattells which were of Charles Ennis
Late of Somersett County dec.d in the hands of Benj.a Tull late of the County afd Planter & Mary his wife Exrx of the
testament and Last will of the afd Charles Ennis being in your bailywick you make nine hundred & sixty nine
pence and one pound of tob.o and seven hundred & sixty two pd.s of tobo which were adjudged unto W.m Ennis
by our Justices at Dividing Creek at Somrsett County afd for his damages which he sustaned as well by occasion
of the Nonperformance of a Certain assumption to the same W.m Ennis by the afd Charles Ennis his Life
time made as for his Costs and Charges by him about his suite in that part Expended whereof the afd Benjamin
Tull and mary his wife are Convict if the afd Benj.a Tull and Mary his wife have so much goods and Chattells
which were the afd Charles Ennis at the time of his death in their hands remaning be administred & if
they have not so much in their hands to be administred that then you Levie the damages and Costs afd of
the proper goods and Chattells of the afd Benjamin Tull and Mary his wife and that you have the same
before the Justices of our County Court to be held at Dividing Creek in Somrsett County afd the third tuesday
of Novem Next to satisfie unto the afd William Ennis his damages and Costs afd and have you then
and there this Writt Wittness &c

          Att which said third tuesday of Novem.r to witt the fifteenth day of the Same month anno Dom
One thousand seven hundred and twenty six Came being the day of the return of the said writt Cometh
the afd William Ennis and the Sherr of Somersett County to whom the foregoeing writt was directed Com
Likewise Cometh and maketh return thereof Endorsed in these words vizt fieri Faci:   Fran: Allen sher

Upon the mocon of George Dashiel to the Court ^that^ a negro woman that belongs to the Children
of Nehemiah Nicholson dec.d that was given unto them by a deed of Guift from Coll Thomas Ennalls
dec.d is by the same Court sett tax free &c

Wailes of a plea of trespass upon the Case &c
        And whereupon ye s.d Andrew by Levin Gale his attorney Complaines that Whereas ye s.d
William the twenty Eight day of Oct Anno Dom one thousand Seven hundred & twenty five
       at Somersett County afd within the Jur of this Court was Indebted unto ye said Andrew in the sum of five
       hundred pounds of tob.o as by acc.t hereunto annexed may in Court appear & so thereof Indebted the said
