thereof or that he the said Lazarus Maddox will do it for him &c

       Whereupon the said Jn.o Newbold in his own proper person Cometh & defendeth the force
and Injury when &c   And saith that he Cannot gainsay but that he did promise & upon
himselfe assume in manner and form as the afd Joseph by dollearing afd above supposed
and the same dalaration in all the words Before Expresly Confesseth

          Therefore it is Considered by the Justices here the fifteenth day of Novem
Anno Dom one thousand seven hundred and Twenty Six that the afd Joseph MccClester
recover against the afd John Newbold Eight hundred & Eighteen pounds of tob.o his damages
afd above In the declaration afd Specified as also two hundred and forty Eight
pounds of tob.o for his Costs and Charges by him about his Suite in that part Expended to
the same Joseph by the Court here of his assent adjudged and the afd deft in mercy

 Command was given to the Sherr of Somersett County that he Should take
Giles Bashaw Late of Somersett County Planter if he Should be found in
his bailywick and him Should Safe Keep so that he might have his body
before the Justices of his Lordships County Court of Somersett to be held at dividing Creek
the third tuesday of Novem then next to satisfied unto a Certain Andrew Scott of two
thousand and sixty good Barrell Staves and Eight hundred and twenty five pounds of
tob.o which were adjudged unto the said Andrew Scott by the County Court of Somersett for his
damages which he sustained as well by Occasion of the Nonperformance of a Certain promise
and assumption afd by the same Giles Bashaw to the afd Andrew Scott Lately made as for
his Costs and Charges by him about his suite in that Part Expended &c  and that thereof he should
not fail &c       Att which said third tuesday of Novem Ann.o To witt the fifteenth day
of the same month Anno Dom One thousand seven hundred and twenty six Cometh the said
Andrew Scott by Levin Gale his attorney and the Sherr of Somersett County to whom the foregoeing
writt was directed and makes return thereof Endorsed viz.t Cepi Corpus p Fran Allen sher

       And whereupon the said Giles bashaw present  here in Court and being by the Sherr sett to
the bar is thereupon at the prayer of the Plfts attorney ^afd^ Committed into the Custody of the
Sherr of Somersett County untill the afd Andw Scott of his damages and Costs afd should be
thereof fully satisfied   the said Sherr Present herein Court took Charge of the Said Giles
Bashaw accordingly &c
