    John Newbold
 Somersett fs     John Newbold Late of Somersett County Planter was attached to

answer unto Joseph MccClester of a plea of trespass upon the Case &c
                            And whereupon the said Joseph by Levin Gale his attorney Complains that whereas
the afd John the tenth day of Novem.r ann.o Dom one thousand Seven hundred and twenty five
at Somersett County within the Jurisdiction of this Court was Indebted unto the same Joseph in the
Sum of Eight hundred and Eighteen pounds of tob.o as by acco.t herewithin Court produced may
appear & so thereof being Indebted the said John in Consideration thereof afterwards
to witt the Same day & year afd at the County afd within the afd Jur
upon himselfe assumed & to the Same Jos then & there faithfully promised
yt he when afterwards he should be thereto requested he the afd Sum
of Eight hundred & Eighteen pd.s of Tob.o unto the Same Joseph wou'd well
& faithfully Content & pay nevertheless the same John his promisse & assumption
afd in form afd made Little regarding & plotting & fraudulently
Intending him the same Joseph in that part Craftilly & Subtilly to defraud
& Deceive he ye afd Sum of Eight hundred & Eighteen pounds of Tob.o or any
part thereof to the same Jos (altho' afterwards to witt the same day & year
afd at the County afd & within the afd Jur) he was thereto requested) hath
not paid nor the same Joseph for it in anywise Contented but the said
John the same hitherto to doe hath altogether refused & still doth refuse
to the Damage of the same Jos Sixteen hundred & thirty six pd.s of Tob.o
and thereof he Brings this suite &c         L Gale P Quer pledges &.c J Doe  R Roe

                  And whereupon the said John Newbold being present in Court is at the ^prayer of ye^ Plft
       attorney afd adjudged to give Speciall Bail to the action afd         Thereupon a Certain Lazarus
Maddox of Pocomoke ^in^ Somersett County Planter present here in Court undertakes for the said
John Newbold that if in Case the said Joseph MccClester shall recover Judgm.t in the plea
afd against the said John Newbold or that the said John Newbold Shall be therein Convict
that then he the said John Newbold shall pay the Condemnation of the Court thereupon
or render his Body to the Custody of the Sherr of Somrsett County in Sattisfaction
