Mary Martin Ex.rx of ye Last Will & Testament of Robert Martin dec.d of a plea yt he
render unto her fourteen hundred & Eighty pd.s of Tob.o which from her he unjustly
detaines &c         And whereupon the same Mary by Levin Gale her attry Complaines
yt whereas ye afd Jn.o the twelfth day of June Anno Dom seventeen hundred
& twenty four at Somrsett County afd within ye Jur of this Court by his Certain
Writing Obligatory granted himselfe to be held & firmly Bound unto R ye afd
Robert Martin in his Lifetime in ye penall Sum of fourteen hundred &
Eighty pd.s of Tob.o to be paid ye Said Rob.t Martin his heirs Executors adm.rs
or assignes when afterwards ye Said Jn.o Should be there to required Nevertheless
ye s.d Jn.o thoo often thereto required the afd Sum of fourteen hundred
& Eighty pd.s of Tob.o to ye Same Rob.t Martin in his Lifetime or to ye
afd Mary Since the death of ye Same robert hath not rendered but the said
John the same hitherto to ye Same Mary to render hath denyed & still doth
deny & unjustly detain whereby ye said Mary says she is worse & hath
Damage to ye value of two thousand Nine hundred & sixty pd.s of Tob.o & thereof
she brings Suite &c         & the Same Mary brings hereinto Court as well ye Letters
testamentary afd as ye writing obligatory afd &c
                                              L Gale P Quer pledges &c   Jn.o Doe Rich.d Roe

       And the said John Anderson in his Own proper person Cometh and defendeth the force
and Injury when &.c and says that he Can not gainsay the action of the Same Mary Martin Exrx of
of the afd Robert Martin Dec.d nor but that he detained the afd fourteen hundred and Eig^h^ty pds
of tobacco in manner and form as the afd Mary above against him declared

                   Therefore it is Considered by the Justices here the fifteenth day of Novem.r
Ann.o Dom One thousand Seven hundred and twenty Six that the afd Mary Martin Exrx as afd
Recover against the afd John Anderson Fourteen hundred and Eighty pounds of tobo his debt
248   afd as also Two hundred and forty Eight               pounds of tobo for her Damages
which she Sustained as well by Occasion of the detention of the Same Debt as for her Costs and
Charges by her about her Suite in that part Expended to the same Mary of her assent by the Court
here adjudged and the afd Deft in mercy &c

Should take ^Edward Coleman^ Late of Somersett County Planter if he Shall be found
in your Bailywick  And him should safe Keep so that he might have his
                body before the Justices of his Lordships County Court of Somersett to be held at Dividing
Creek the third tuesday of Novemr then next to answer unto Thomas MccCoster of a plea of
