trespass upon the Case &c and that thereof he should not fail &c

          Att which said third tuesday of November to witt the fifteenth day of the same
month ann.o Dom One thousand Seven and twenty six being the day of the return of
the said Writt Cometh the said Thomas MccCoster in his proper person and the sherr
of Somersett County to whom the foregoeing writt was directed Likewise Cometh &
maketh return thereof to the Court here Endorsed vizt Cepi Corpus p Fran Allen sher

          Whereupon the afd Edward Coleman in his Own proper person Comes and Defends
the force and Injury when &.c and offers himselfe against the afd Thomas MccCoster in
the plea afd afd but the said Thomas altho' Solemnly Called Cometh not nor in his writt in
the plea afd against the afd Edward Coleman further prosecuted &c

                         Therefore it is Considered by the Justices here the fifteenth day
of Novem Ann Dom One thousand seven hundred and twenty six that the afd Thomas
MccCoster and his pledges of Prosecuting be in mercy &c and lett the Names of his said
pledges be sought for &c and that the afd Edward Coleman goe thereof without day   And
further by the Court here it is Considered that the afd Edward Coleman Recover against the
afd Thomas MccCoster forty three                                    pounds of tobo for his Costs and
Charges about his defence by him in that part sustained to the same Edward by the Court
here adjudged according to the form of the Statute thereof Lately made & provided adjudged
and that the same Edward have thereof Execution &c

       White Late of the same place Gent dec.d of a plea that he render unto them Nine thousand two hundred
       fifty three pounds of good sound merchantable Leafe tob.o in Cask which from them he unjustly
       Detains &c
                                                                         And Whereupon the same Will.m Southy Esther
       and Hannah by Levin Gale their attry say that whereas the afd Thomas the tenth day of
       march Anno Dom one thousand seven hundred & Seventeen Eighteen at Somrsett County afd
       within the Jurisdiction of this Court by his Certain Writing Obligatory which the same W.m
