Novem Court
1726 206 thousand Seven hundred and twenty Six Came again as well the afd John Tull by his attorney afd as the afd Thomas Fletcher by his attorney afd and thereupon the said Thomas Fletcher by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also Att which said next Court to witt the fifteenth day of Novem to witt the Anno Dom One thousand Seven hundred and twenty Six Cometh againe as well the afd P John Tull as the afd Thomas Fletcher by their attorneys afd and thereupon the said Thomas Fletcher by his said attorney says that he Cannot gainsay the action afd of the afd John so as afd against him brought nor Can he say but that the Same John Ought to recover his damages by occasion of the premisses afd to three pound seven Shillings Curr.t ^silver^ money and Costs of Suite against him which the same plft does not gainsay Therefore it is Considered by the Justices here the fifteenth day of Novem Ann.o Dom One thousand seven hundred and twenty Six afd that the afd John Tull recover ag.t the af Thomas Fletcher three pounds seven shillings & silver money his damages afd in form 250 afd Confesed as also Two hundred and fifty pounds of tobacco for his Costs and Charges by him about his Suite in that part Expended to the Same John by the Court here of his assent adjudged and the afd Deft in Mercy &c
hundred and twenty six at Somersett County within the Jur of this Court was Indebted unto the same Joseph in the Sum of four hundred and Seventy Seven pounds of tob.o as by Acc.o herewithin Court produced May appear & so thereof Being Indebted the same Joseph in Consideration thereof afterwards to witt ye same day & Year afd at the County afd within the Jur afd upon himselfe assumed & to the same Joseph then and there faithfully promised that he when afterwards he should be thereto requested he the afd Sum of four hundred and Seventy Seven pd.s of tob.o to the same Jos: would well and faithfully Content and pay Nevertheless the Same John his promise & assumption afd in form afd made Little regarding & plotting & fraudulently Intending the same Joseph in that part Craftilly and Subtilly to defraud & deceive he the afd sum of four hundred & Seventy Seven pounds of tob.o or any part thereof to the same Joseph hath not paid altho' the said John afterwards to witt the same day & year afd at the County afd within the afd Jur was there met by the same Joseph Requested but the said John the same hitherto to doe hath altogether Refused & still doth refuse Whereby the said (Joseph) |
