206 Asser Sharp for his damages afd by way of attachm.t According to Act of assembly &c Whereupon for that it seems to the Court here that the said Aaron Linn has Complyed with the Law as alledged, Therefore it is Considered by the Justices here the fifteenth day of Novem Ann Dom one thousand seven hundred & twenty six afd that the said Aaron Linn Recover against the said Asser Sharp as well the sum of seventeen pd.s twelve shilling & four pence 306 Curr.t mony his Damages by occasion of the premisses afd as all Costs and Charges by the said Plft Laid out and Expended about his suite by way of attachm.t against the goods Chattells rights or Creditts of the said Asser Sharp According to Act of assembly in such Case made and provided &c
day of June Anno Dom One thousand seven hundred & twenty five at Somrsett County within the Jur of this Court was Indebted unto the afd Jn.o In y.e sum of three pd.s seven shills Silver Money as by his Certain Note herewith in Court produced may appear & so thereof being Indebted the same Tho.s in Consideration thereof afterwards to witt y.e same day & year afd at y.e County afd with.in the afd Jur upon himselfe assumed to y.e same Jn.o then & there faithfully promissed that he when afterwards he should be thereto requested y.e afd Sum of three pd.s Seven Shill.s Silver Money to y.e same John would well & faithfully Content & pay Nevertheless y.e said Thomas his promise & assumption afd in form afd made Little regarding but plotting & fraudulently Intending the afd Jn.o in y.t part to defraud & Deceive he the Said Tho.s the afd sum of three pd.s seven shills Silver money or any part thereof to y.e same Jn.o although afterwards to witt y.e same day & year afd at y.e County afd within y.e afd Jur he was thereto requested) he hath not paid or nor the same Jn.o for it anywise Contented but the Same hitherto to doe hath altogether refused & still doth refuse to y.e Damage of y.e same Jn.o of Six pounds fourteen Shill of Like Money & thereof he Brings this Suite &c L Gale P Quer pledges &c J Doe R Roe And the afd Thomas Fletcher by George Dashiell his attorney Cometh and defendeth the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft also Att which said next Court to witt the sixteenth day of august Anno Dom one thousand |
