 Command was given to the Sherr of Somersett County that he should take asser
Sharpe Late of Somersett County Gent if he Should be found in his Bailywick
and him safe Keep so that he might have his Body before the Justices of his
Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of Novem yn
next to answer unto Aaron Linn of a plea of trespass upon the Case &c and that thereof he
should not fail &c            And whereupon the same Aaron By Levin Gale his attry Complaines
that whereas the afd Asser the tenth day of June Anno Dom One thousand seven hundred & twenty six
at Somersett County within the Jur of this Court was Indebted to the same Aaron Linn in the Sum
of seventeen pounds twelve Shillings & four pence Currant mony of as by acc.o herewithin Court
produced may appear and so thereof Being Indebted the same Aaron in Consideration thereof afterwards
to witt the same day and year afd at the County afd within the Jur afd upon himselfe
assumed and to the Same Aaron then and there faithfully Promised that he when afterwards
he should be thereto requested he the afd Sum of Seventeen pd.s twelve shillings & four pence
Curr.t mony to the same Aaron wou'd well & faithfully Content and pay Nevertheless ye same asser
his promise and assumption afd in forme afd made Little regarding and Plotting & fraudulently
Intending the same Aaron in that part Crafitlly & Subtilly to defraud and Deceive he the
afd sum of seventeen pd.s twelve shillings and four pence Curr.t mony or any part thereof to ye same
Aaron hath not paid altho' the Said Asser afterwards to witt the same day and Year afd at the
County afd within the afd Jur was thereunto by the Same Aaron requested but the said Asser
the same hitherto to doe hath altogether Refused and Still doth refuse whereby the said
Aaron says he is worse and hath damage to the value of forty pounds Curr.t mony and thereof
he Brings this Suite &c                                          L Gale P Qur pledges &.c  J Doe R Roe

said Aaron Linn by his Attry afd and the Sherr of Somrsett County to whom the foregoing writt
was directed Likewise Comes and Makes return thereof to the Court here Endorst in these words
viz.t   Non East Inventus Short Note Left P Francis Allen Sherr

             Whereupon the Said Aaron Lin by his attorney afd prays that for as much as
he has Complyed with the Law in Order to an attachment he may have Judgm.t ag.t the sd
