Court 1726 205 thousand seven hundred & twenty six at Somrsett County within y.e Jur of this Court was Indebted to y.e same Geo in y.e sum of two pd.s ten shills Curr.t Money as by acc.t herewithin Court produced may appear & so thereof being Indebted y.e same John In Consideration thereof afterwards to witt y.e same day & year afd at y.e County afd within y.e Jur afd upon himselfe assumed & to y.e same Geo then & there faithfully promissed yt he when afterwards he Should be thereto requested he y.e afd sum of two pd.s ten shill.s Curr.t Money to y.e same Geo would well & faithfully Content & pay Nevertheless y.e same Jn.o his promisse & assumption afd in forme afd made Little regarding & plotting & fraudulently Intending y.e same Geo in yt part Craftilly & Subtilly to Defraud & Deceive he y.e afd Sum of two pd.s ten Shills Currant Money or any part thereof to y.e same Geo: hath not paid altho y.e s.d Jn.o afterwards to witt y.e same day & year afd at County afd within y.e afd Jur was thereunto by y.e same Geo requested but y.e s.d Jn.o the same hitherto to doe hath altogether refused & still doth refuse whereby the said George says he is worse & hath Damage to y.e value of five pd.s Currant Money & thereof he brings this suite &c Dashiell in p per person pledges &.c Jno Doe R Roe
Nov.r 1726 Att which said third tuesday of November to witt y.e fifteenth day of y.e same Month Anno Dom One thousand seven hundred & twenty six being y.e day of the return of y.e said Writt Comes y.e said George Dashiell in his own proper person & y.e sher of Somrsett County to whome y.e foregoeing writt was directed Likewise Comes & makes return thereof to y.e Court here Indorsed in these words viz.t Non Est Inventus shorte note Left p Francis Allen Sher Whereupon the said George Dashiell Prays yt forasmuch as he has Complyed with y.e Law in Order to an attachment he may have Judgm.t against y.e said John Hope for his damages afd by way of attachment according to act of assembly &c Whereupon for that as it seems to y.e Court here y.t y.e s.d George Dashiell has Complied with y.e Law as alledged Therefore it is Considered by y.e Justices here y.e fifteenth day of November Anno Dom One thousand seven hundred & twenty six afd y.t y.e said George Dashiell recover against y.e said Jn.o Hope as well y.e sum of two pd.s ten shills Curr.t Da Money his damages 200 by occasion of y.e premisses afd as all Costs & Charges by y.e said Plft Laid Out & Expended about his suite by way of attachm.t against the Good Chattles rights or Creditts of y.e s.d Jn.o Hope according to act of assembly in such Case made & provided &c |
