1726 203 Conveniant you Meet on ye afd Land Called Golden Quarter you first having Taken your Oaths on ye Holy Evangelist of almighty god according to act of assembly in such Case made & provided) & there Cause to Come before you or any three or two of you all such Evidences as shall be to you or any three of or two of you Nominated by ye sd Complaniant (or Deft if any) & yt you your Examine them upon their Corporall Oaths to be by you or any three or two of you administred on ye Holy Evengelist of almighty god in ye presence of ye Complainant (or Deft if any) touching ye truth or remembrance of there Knowledge or any thing yt may relate to the Cause afd & yt reduceing ye severall Depositions into Writing you Send ye Same together with this our Commission under your or any three or two of your hands to us to our County Court of Somrsett with all Conveniant Speed Wittness Samuel Hopkins Gent Chief Justice of our Said Court ye 24.th day of June in ye 11.th year of our Dominion &.c Anno Dom 1726 Tho.s Hayward Cler (p order) On the Back Side of ye foregoing Commission it was thus Endorsed vizt Memorandum y.t this day viz.t the 15th day of August 1726 Came before me Cap.t Will.m Fasitt & James Round in there proper persons & Made oath upon ye Holy Evengelist y.t they would duly Execute ye Commission according to ye tenour & Effect thereof as Witness my hand Sam.ll Hopkins Somrsett County fs: In Obedience to a precept hereunto annexed we Will.m Fasitt & James Round haveing been qualified & due Notice given met on ye tract of Land Called Golden Quarter ye seventeenth day of september 1726 & in ye presence of ye Complaniant (no Defend.t appearing) Came Capt Will.m Fasitt an Evidence aged 64 years or thereabouts & being sworn & Examined sayth yt at a point of woods By a marsh side about 160 paces down a Creek from an old Landing near 2 red Oak Saplings & 1 white oak Sapling Standing triangular there or thereabouts ye sd Evidence in ye Lifetime of Edward Smith Jun.r he very well remembers he saw a thriving pignut hiccory Marked with a serveyers Mark on 4 sides & yt it was a bounder of Golden Quarter The Same day & at ye same place Came John Patie an Evidence aged 56 years or thereabouts being Sworn & Examined sayth yt in ye Life time of Jn.o Johnson he Leased Golden Quarter of ye sd Johnson ye Said Johnson dying one Peter Cammell Claimed a right in ye Land yt ye sd Patie had Leased of ye said Johnson ye sd Paties Lease not then being Expir'd & they having a dispute about it ye sd Peter Cammell Came with this Depon.t to ye place described in ye first Evidence & sho'd this depon.t a Hiccory Stump with ye Top Broke of & then ye sd Stump was Marked with a serveyers Marks & ye said Cammell told this Evidence |
