202 On the Back side of the foregoing Commission it was thus Edorsed viz.t Memorand.m that this day viz.t the 20.th day of may 1726 Came before me James Rownd & Rich.d Hudson in their proper ^persons^ & made oath ^up^on the holy Evangelest that they would duly Execute the within Commission according to the form and Effect thereof as Wittness my hand Samuel Hopkins Memorandum that this day viz.t y.e 11.th of June John Tull did Quallifie himselfe after the same Manner that the above James Rownd and Richard Hudson did as Wittness my hand Somrsett County fs Will.m Fasitt In Obediance to a preceipt hereunto annexed we James Rownd Rich.d Hudson and John Tull having been Quallifyed & due Notice given met on ye 2 tracts of Land mentioned in the said Precept the Eleventh day of June 1726 & in the presents of the Complainent Came Cap.t Will.m Fasitt an Evidence aged 64 years ye 29.th of may Last past & being sworn & Examined saith that at a dead white oake standing at the side of a glade near a large flourishing white oake being about 350 paces near S.o E.t from the house where Thomas Farrall now dwelleth y.t about 30 odd years agon the said Evidence had frequent Business down that neck & then saw this dead white oake a thriving tree marked with a surveyors marke & enquiring what tree it was the people told him it was a dividing tree Between the Lands of Coll Jenkens & Robt Johnson but Knows not the name of the land it stands upon also the said Deponent says that he showed ye sd tree about 8 years agon to Sam.l Bratton & then it was a thriving tree & not defaced The Same day M.rs Mary Hampton appear'd as deft in relation to ye Bounds of ye 2 tracts of Land & on that tract of Land Called friends denyall Came W.m Stevenson an Evidence for the said Deft aged 66 years or thereabouts & Being Sworne & Examined saith that a living white oake he very well remembers about 14 years agon Sam.ll Bratton & ye sd deponent was about buying of friends Denyall of Rob.t Johnson & ye Rob.t Johnson at ye sd tree being marked with a Surveyors marke Standing at the mouth of a Creek Issuing out of S.t Martins river with friends denyall Pattent in the said Johnsons Hand said that ye sd white oake is the first Bounder of friends denyall & that where the breadth of 400 Acres of friends denyall ends there Greene made of 50 acres begins & so traverses Back to the said white oake & 10 pole further into the river the same day & place ye sd Deponent pointed down ye neckward & said Rob.t Johnson told him there was some Clear Land that way & one Baxter & Greene had markt some trees there John Tull one of the Commissioners afd ye same day & place as was mentioned in Stevenson's Evidence Came as an Evidence on behalfe of ye deft afd aged 45 years or thereabouts & being sworn & Examined sayth y.t about 5 or 6 years agon y.t Rob.t Johnson afd Employed Rob.t Martin dec.l to run out friends denyall & Green mede & begun at ye white oake Last mentioned rob.t Johnson Saying that it was his first Bounder ye sd deponent Carried the Chain from thence & Saith that at ye Extent of the first Line rob.t Johnson told him he wo'd put up a Cedar post but did not do it ^then^ but then afterwards ye sd deponent saw one (standing) |
