201 Thereunto requested She ye afore s.d sum of fifty five Bushells Indian Corn to the Same John would well and faithfully Content and pay Nevertheless the said Catherine & her promiss and assumption afos.d in form afors.d Made Little regarding but Plotting and fraudulen^t^ly Intending the Afors.d John in that part to Defraud & Deceive She the Afores.d sum of fifty five Bushells of Indian Corn or any part thereof to the same John haith not paid or him for it in any wise Contented Although the s.d Catherine Afterwards to wit the same Day and Year Afors.d at the County Afors.d & within the Afors.d Jun was thereto by the Same John requested but he s.d Catherine the same hetherto to Doe hath Altogether refused and still Doth refuse to the Damage of the Same John of one hundred and ten Bushells of Like Corne and thereof he brings his Suit Levin Gale P Quer Pledges &c Jno Do R Roe And the afd Catherine Dial by George Dashiell her attorney Comes and Defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and she hath it and the same day is given to the afd Plft here also Att which said next Court to witt the fifteenth day of Novem anno Dom One thousand seven hundred and twenty Six Came again as well the afd John as the afd Catherine by their attorneys afd and thereupon the said Catherine by her attorney afd says that She Cannot gainsay but that She assumed upon herselfe in maner and form as the afd John above against her declared nor but she Oweth the afd John the afd fifty five Bushells of Indian Corn and al and Singular the declaration before in Every word Con Expressly Confeseth &c Therefore it is Considered by the Justices here the Same day and year Last mentioned that the afd John Harper Recover against the afd Catherine Dyall fifty five Bushells of Indian Corn his damages afd above in the declaration afd specified as also three hundred and thirteen pds of tobacco for his Costs and Charges by him about his Suite in that part Expended to the same John by the court here of his assent adjudged and the afd Deft in mercy &c Simon a negro Boy belonging to Robert Mills is adjudged to the age of ten years &c Whereas a Certain Abraham Smith of Somersett County Gent Comes into Court this day to witt the fifteenth day of Novem One thousand Seven hundred and twenty Six and Exhibitts an acco.t of runaway time against his Servant named John Swan who had |
