1726 199 not to be Condemned and Execution thereof had and made according to the form of the act of assembly in Such Case made and provided if to him her or them it Shall Seem mete and how you Shall Execute this writt that you make known unto Our said Justices at the same day and place afd and have you then and there this writt Wittness &a Att which said third tuesday of June to witt the twenty first day of the same month ann.o Dom One thousand seven hundred and twenty Six being the day of the return of the Said Writt Cometh the afd Joseph MccClester by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Attached full value in the hands of Samuel Fluellin and John ^Barkley^ and Sumoned them to appear as garnishes as by the within writt I am Comanded so answers Fra Allen sher And the said Samuel Fluellin garnishee as afd by George Dashiell by his attorney Comes and defends the force and Injury when &.c and prays Leave ^thereat^ to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft here also &c Att which said next Court to witt the Sixteenth day of August Anno Dom One thousand seven hundred and twenty Six Come againe as well the afd Joseph MccClester as the afd Samuel Fluellin garnishee as afd by their attorneys afd and the said Samuel Fluellin by his said attrny prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the afd Plft also &c Att which said next Court to witt the fifteenth day of Novem Anno Dom One thousand seven hundred and twenty Six Came againe as well the afd Joseph MccClester as the afd Saml Fluellin by their attorneys afd and thereupon the Said Samuel Fluellin Garnishee as afd says that he Cannot ^gainsay^ but that he has of the rights and Creditts of the Said Cornelius Walkerson to the value of six pounds ten Shillings Currt money nor but that the Same Ought to be Condemned in his hands for the use of the afd Joseph MccClester as of the rights and Creditts of the said Cornelius Watkinson which the said plft doth not gainsay &c Whereupon the said Joseph by his attorney afd prays that the afd Sum of Six pounds ten Shillings Curr.t mony so as afd Confessed by the afd Sam.l Fluellin as of the rights and Creditts of the said Cornelius Watkinson may be Condemned in the hands of the afd Sam.l Fluellin Therefore it is Considered by the Justices here the Same day and Year ^afd^ Last mentioned that the afd sum of six pounds ten Shillings Curr.t mony afd Confessed be Condemned in the hands of the afd Sam.l Fluellin as of the rights and Creditts of the afd Cornelius Watkinson for the use of the afd Joseph MaClester also ^it is Considered^ that he recover against the afd Joseph M Saml 179 Fluellin the sum of one hundred and seventy Nine pounds of tobo for his Costs and Charges by the Court here of his assent adjudged and that he have thereof his Execution & the afd Deft in mercy &c |
