assumption afd against the afd James ought to recover   whereupon the Justices here
at the prayer of the afd Thomas and by the Consent of the afd James according to act
of assembly in Such Case made and provided do assess the damages of the Same Thomas
by Occasion of the non performance of the promise and assumption afd besides his
Costs and Charges by him about his Suite in that part Expended to one Young Cow and
Calfe &c
                                           Therefore it is Considered by the Justices here the fifteenth
day of Novem Anno Dom One thousand seven hundred and twenty Six afd that the afd
Thomas Hugg recover against the afd James Smith one young Cow and Calfe his damages
afd by the Justices afd in form afd assessed as also the Sum of two hundred and
Eighty five pounds of tobacco for his Costs and Charges by him about his Suite in that part
Expended to the same Thomas by the Court here of his assent adjudged and the afd James
in mercy &c

Lordships writt of attachm.t against the defendent the tenor
whereof follows in these words vizt
Somersett fs  Charles absolute Lord and proprietary of the
                       provinces of maryland and Avalon Lord Baron of Baltemore &c  To the
       Sherr of Somersett County Greeting we Command you that you attach any the goods Chattells
       Rights or Creditts of Cornelius Watkinson Late of Somersett County planter if they shall
       be found in your Bailywick to the value of one thousand four hundred and fifty pounds
       of tobacco and when you have the Same attached or any part thereof the Same in your
       Custody safe Keep so that you have the Same Before the Justices of Our County Court to
       be held at Dividing Creek the third tuesday of June next then and there to be Condemned
       according to Law to and for the Use of a Certain Joseph MccClester unless the said Cornelius
       Watkinson by himselfe or his attorney Shall appear and answer unto the said Joseph
       MccClester in a plea of trespass upon the Case &.c According to Law and that by good &
       Lawfull men of your Bailywick you make known unto the person or persons in
       whose hands you make the Same attachm.t that he She or they be and appear before the
       Justices of our said County Court to be held as afd to Shew Cause if any he She or they have
       why the same goods Chattells Rights or Creditts so attached in his her of or their hands ought
