Novemr Court            Anno 1726                  194

Attorneys afd    And the said Tobias by his said attorney prays further Leave
thereof to Imparle hereunto untill the next Court and he hath it and the Same
day is given to the afd plft here also

    Att which said Next Court to witt the Sixteenth day of August Ann.o Dom One
thousand Seven hundred and twenty six Came againe as well the afd Joseph as
the afd Tobias by their attorneys afd and the said Tobias by his said attorney
prays further Leave to thereof to Imparle hereunto untill the next Court and he
hath it and the Same Day is given to the afd plft here also

          Att which said next Court to witt the fifteenth day of November Anno Dom
One thousand seven hundred and twenty six Came as well the afd Joseph as the
afd Tobias by their attorneys afd   and the afd Tobias attorney of the Said Tobias says
that he is not Informed by the Same Tobias his Clayant of any Answer for the Same
Tobias to the afd Joseph in the plea afd to be given and nothing Else thereof
says by which the same plft remains against the afd deft thereof undefended

       Wherefore the afd Joseph his Damages by Occasion of the Non performance
of the promise and Assumption afd against the afd Tobias Ought to recover
&.c  Whereupon at the prayer of the same plft and by the Consent of the Same
Deft the Justices here according to act of assembly in such Case made & provided
do assess the Damages of the same Joseph by Occasion of the Non performance
of the promise and assumption afd besides his Costs and Charges by him about his Suite
in that part Expended to fourteen hundred and twenty One pounds of tobo

             Therefore it is Considered by the Court here the Same day and Year
Last mentioned that the afd Joseph MccClester Recover against the afd Tobias
Burke as well the Sum of fourteen hundred and twenty one pounds of tobacco his
Damages afd in form afd by the Justices afd assessed as also the sum of
269   two hundred and sixty Nine pounds of tobacco for his Costs and Charges by him about
his Suite in that part Expended to the same Joseph by the Court here of his assent
adjudged and the afd Deft in mercy &c
