       Novem Court      1726     193

seven hundred and twenty five at Somersett County afd within the Jurisdiction of this
Court was Indebted unto the afd Joseph in ye sum of Sixteen hundred & forty Nine
pounds of Tob.o as by acc.t here within Court produced may appear & soe thereof
being Processed ^Indebted^ the same Tobias in Consideration thereof afterwards to witt
the Same day & Year afd at ye County afd & within ye afd Jur upon himselfe assumed
& to ye said Jos: then & there faithfully promised that he when afterwards
he Should be thereto requested he ye afd sum of Sixteen hundred &
forty Nine pounds of Tob.o to ye same Jos: woud well & faithfully Content &
pay Nevertheless ye same Tobias his promiss & assumption afd in form afd
Made Little reguarding & plotting & fraudulently Intending ye sd Joseph
in yt part Craftilly & Subtilly to defraud & Deceive he ye same Tobias ye sd
Sum of Sixteen hundred & forty Nine pounds of Tob.o or any part thereof
to ye Same Joseph (although afterwards to witt ye Same day & Year afd at ye County
afd within ye afd Jur: he was thereto requested) he hath not paid or ye same
Jos: for it In anywise Contented but ye said Tobias ye same hitherto to
Doe hath altogether refused & still doth refuse to ye Damage of ye sd
Joseph of three thousand two hundred & Ninety Eight pounds of Tob.o &
thereof he brings this suite &a            L Gale P Quer pledges &.a Jn.o Doe R.d Roe
