Creek the third tuesday of march then next to answer unto Robert Truman of a plea of trespass upon the Case and that thereof he Should not fail &a Att which said third tuesday of march ^to witt^ being the fifteenth day of the same month anno Dom one thousand Seven hundred and twenty five Cometh the said Robert Truman by Levin Gale his attorney and the Sherr of Somersett County to whom the foregoing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Fran Allen sherr And the Said Patrick Burn by George Dashiell his attorney Cometh and defendeth the force and Injury when &a and prays Leave thereof to Imparle hereunto untill the next Court and he hath ^it^ & the same day is given to the afd ^Plft^ Deft here also Att which said next Court to witt the twenty first day of June anno Dom One thousand seven hundred and twenty six Came again as well the afd Plft as the afd Deft by their attorneys afd and the afd Deft by his said attorney prays further Leave thereof to Imparle hereunto untill the next Court and he hath it and the Same Day is given to the afd Plft here also Att which said next Court to witt the Sixteenth day of August Anno Dom One thousand Seven hundred and twenty six Came again as well the afd Plft as the afd Deft by their said attorneys ^afd^ and the said Deft by his said attorney prays further Leave thereof to Imparle hereunto untill the Next Court and he hath it and the Same Day is given to the afd Deft here also Att which said next Court to witt the fifteenth day of Novem anno Dom One thousand seven hundred and twenty Six Came again as well the afd Robert as the afd Patrick by their attorneys afd And the afd Robert Truman then and there his writt afd against the afd Patrick Burn did not prosecute with Effect but voluntarily Suffered his Suite to be discontinued Therefore afterwards viz.t the Same day and Year by Discretion of the Justices here were adjudged the Same Patrick Burn the Sum of two hundred ^and seven^ pds pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained according to the form of the Statute in Such Case thereof Lately made and provided and the afd Patrick Burn Robert Truman in mercy and that the afd Patrick Burn have thereof Execution
