191 in the Same Action was directed Comes and makes Return thereof Endorsed in these words vizt Cepi Corpus P Francis Allen Sherr Whereupon the afd Joseph Holder being Called appears and thereupon the said Joseph Holder at the prayer of the afd Joseph MccClester by his attorney is adjudged to give Speciall Bayle to the action afd thereupon a Certain John Holder of Somersett County planter present herein Court undertakes for the afd Joseph Holder that in Case the said Joseph MccClester shall recover Judgm.t in the plea afd against the afd Joseph Holder or that the said Joseph Holder shall be therein Convict that then he the said Joseph Holder shall pay the Condemnation of the Court thereupon unto or render his Body to the Custody of the Sherr of Somersett County in satisfaction thereof or that he the said John Holder will do it for him thereupon the said Joseph Holder by George Dashiell his attorney appears and Imparles till next Court &a
of Novem then next ^to answer unto George Tull of a plea of trespass upon the Case &a^ and that thereof he should not fail &a And the afd George Tull by Levin Gale his attorney proceeded against the afd Griffin Thomas in the plea afd as followeth vizt Somersett fs: Griffin Thomas Late of Somrsett County Planter was attached to answer unto George Tull of a plea of Trespass upon ye Case &a And whereupon ye Same George by Levin Gale his attorney Complaines that whereas ye afd Griffin ye tenth day of July Anno Dom One thousand seven hundred & twenty four at Somersett County within ye Jur of this Court was Indebted to the same George in ye Sum of ten pounds twelve Shill.s & Eleven pence Curr.t Money of Maryland for Divers Goods Wares & Merchandizes & for work Before yt Time By ye Said George to ye said Griffin at his Especiall Instance & request Sold delivered Done & performed & so thereof being Indebted ye Same Griffin In Consideration thereof afterwards to witt ye same Day & Year afd at ye County afd within ye afd Jur upon himselfe assumed & to ye Same George then & there faithfully promised yt he when afterwards he should be thereto requested he ye said Griffin ye said sum of ten pounds twelve Shillings and Eleven pence Currant money to the Same George would well and faithfully Content and pay nevertheless the said Griffin his promise and assumption afd in form afd made Little Regarding and plotting and Fraudulently Intending the afd George in this part Crafitlly and Subtilly to deceive and Defraud he the afd Sum of ten pounds twelve Shill.s and Eleven pence Currant money or any part thereof to the Same George (altho' often afterwards to witt the Same day and Year afd at the County afd within the Jurisdiction afd by the same George the said Griffin was thereto requested) he hath not paid or the same for it any wise Contented (but) |
