but the Same Griffin the Same hitherto to doe hath altogether Refused and still doth
Refuse to the Damage of the Same George of twenty pounds Curr.t mony and thereof he
bringeth this Suite &.c            L Gale P Qur   Pledges &.c Jno Doe Richd Roe
a Copy of the for^e^goeing declaration was made and Sent to be served on the deft with
the writt in the plea afd

    Att which said third tuesday of Novem to witt the fifteenth day of the Same month
Anno Dom One thousand Seven hundred and twenty Six Cometh the said George Tull by his
attorney afd and the Sherr of Somersett County to whom the for^e^goeing writt was directed
likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following
viz.t Cepi Corpus ^decl Del.d in time^ P Francis Allen Sherr

    And the afd Griffin Thomas by George Dashiell his attorney Cometh and Defendeth the
force and Injury when &.c  And it is said by the Court here to the afd attorney of the afd
Griffin that for the Same Griffin his Clyant to the afd George in the plea afd answer
whereupon the Same attorney of the afd Griffin say that he is not Informed by the afd
Griffin his Clyant of any Answer to the afd Plantiffe in the plea afd to be given nor Nothing
Else thereof Says for Which the same plft Remaineth against the afd Deft thereof undefended

    wherefore the afd Plft his damages by Occasion of the non performance of the promise
and assumption afd against the afd Griffin Ought to recover &.c whereupon the Justices
here at the prayer of the afd George and by the Consent of the afd Griffin according to
act of assembly in Such Case made and provided say that the afd Griffin did not assume
upon himselfe in manner and form as the afd George against him above Complained &.c

             Therefore it is Considered by the Justices here the fifteenth day of Novem Ann.o
Dom One thousand Seven hundred and twenty Six that the afd George Tull take nothing by his
writt and declaration afd but be in mery for his falce Clamour and that the afd Griffin Thomas
Goe thereof without Day also it is Considered by the Justices that the afd Griffin Thomas
Recover Against the afd George Tull the Sum of two hundred and twenty Seven pounds
of tobacco for his Costs and Charges by him about his Suite in that part Expended to the Same
Griffin by the Court here of his assent according to the form of the Statute in such Cases Latly made
and provided adjudged &c
