on the part of y.e afd Peter Whiting in our Court before us we have accepted
& altho Judgm.t be thereupon rendered Nevertheless Execution of y.e Damages
& Costs afd as yett remaineth to be done to y.e retardation of y.e Execution of the
Administration afd whereupon y.e afd Peter Whiting hath supplicated us for
a proper remedy in y.t part to him to be provided & because we are willing yt
those things which in our Said County Court are rightfully done so Should
Come to a due Execution   We Command you yt by good & Lawfull men of your
Bailywick you Make Known unto y.e afd Tho.s Billin y.t he be & appear
Before y.e Justices of our County Court of Somrsett to be held at Dividing Creek
the third tuesday of November Next to Shew Cause if anything for himselfe
he hath or Knoweth to Say wherefore y.e afd Peter Whiting his Execution
against him of y.e Damages & Costs afd to have Ought not according to y.e
form of & Effect of y.e recovery afd if unto him it shall seem Expedient &
have you then & there y.e Names of thoes before whom you Make y.e Same
Known & this Writt Wittness Samuel Hopkins Gent Chief Justice of our
Said Court this 19.th day of August in y.e Eleventh Year of our Dominion &c
Anno Dom 1726

Att which said third tuesday of Novem.r to witt the fifteenth day of the same
month anno Dom One thousand Seven hundred and twenty six being the day of
the Return of the said writt Cometh the Said Peter Whitting adm.r of the afd
Jeffry Flowers by his attorney afd and the Sherr of Somersett County to whom the
foregoeing writt was directed Likewise Cometh and maketh Return thereof to the
Court here Endorsed viz.t made Known p me   Francis Allen Sherr

       Whereupon the afd Peter Whitting adm.r as afd by his attorney afd prays Execution
against the afd Thomas Billin of the Damages and Costs afd But the afd Thomas
Billin altho' Solemnly Called Cometh not but makes Default   Therefore it is Considered
by the Justices here the fifteenth day of Novem.r Anno Dom One thousand seven hundred
and twenty six that the af Peter Whitting Adm.r as afd have his Execution against the afd
Thomas Bill^in^ for as well the sum of twenty three pounds Nine Shillings and ten pence Currt
money of maryland and seven hundred and Ninty Six pounds of tobo ^his^ Damages and Costs
318   afd as also the Sum of Three hundred & Eighteen           pounds of tobo for his
Costs and Charges sustained by Occasion of Delay of Execution of the Judgmt afd &c
