       his heirs and successors   In case the said William West do not make his personall
       appearance before the Justices of his said Lordship's County Court of Somersett to be held
       at dividing Creek the third tuesday of march then next to give such evidence as he Shall
       know against the afd Thomas Bannister and Anthony West of and Concerning their
       feloniously stealing of forty pounds Curr.t money of maryland the proper money
       of a Certain John Williams and do not depart the Same Court without Lycence thereof
       otherwise to remaine in full force and vertue &c

Lord and proprietary of the provinces of maryland &.c upon their
                   Oath do present that Anthony West Late of Somersett parish in the County afd
       the Sixteenth day of November ann.o Dom One thousand Seven hundred and twenty Six at
       the Place afd in the County afd with force and arms in and upon Peter Fitzgerrell in the
       peace of God &.c being did make an assault and affray and him the said Peter Fitzgerrell
       then and there with force and arms did beat wound and Evill Intreat so that he did
       dispair of his Life and Other harms unto him did to the great Damage of the Said
       Peter Fitzgerrell and against the peace &.c      Dashiell Cl Indictmts
       Testis      Peter Fitzgerrell
                                        On the back side of the foregoeing bill of Indictm.t it was thus
       Endorsed vizt            Billa Vera Jos: Macclester

                   Thereupon Command was given to the Sherr of Somersett County that he Should
       take the afd Anthony West if &.c to answer &.c  Afterwards in the Same Court Came
       the said Anthony West and being by the said Sherr sett to the Barr (Indictm.t read) says
       that of the premisses afd as by the Indictm.t above upon him Imposed he is not guilty
       thereof and of this puts himselfe upon the Country and George Dashiell who for his said
       Lordship in that part presents Likewise

                      Thereupon Command is ^again^ given to the Sherr of Somersett County that Immediately
       he Cause to Come here twelve &.c who neither &.c to recognize &.c because as well &.c of
       which said preceipt the Said Sherr to witt Francis Allen Gent Now hereat to witt this ^six^fifteenth
       day of Novem.r one thousand seven hundred and twenty six cometh and maketh return that
       he has here Ready twelve &.c as by his said preceipt he was Commanded and ^as well^ the said George
       Dashiell who followeth &.c as the said Anthony West in his proper person being present the
       Jurors of that Jury Impannelled who being Called likewise Came to witt John Donelson Lewis
