177 the afd William hath sustained as by Occasion of the Non performance of the promise and assumption afd as for his Costs and Charges by him about his Suite in that part Expended ^sustained^ and the Inquisition which thereof he should take to his Lordships Justices at Dividing Creek the third tuesday of March next under his seall and the Seals of those by whose Oath he make the same Inquisition he Send with the on writt to him thereof Directed &.c The same day is given to the afd William there &.c Att the third tuesday august one thousand seven hundred and twenty six before his Lordships Justices at Dividing Creek Comth the afd William Ennis by his attorney afd and the Sherr Returned a certain Inquisition before him taken at snow hill town in the County of Somersett the twelfth day of July one thousand seven hundred and twenty six by which it appears that the afd William hath Sustained Damage by Occasion of the Non performance of the promise and assumption afd besides his Costs and Charges by him about his Suite in that part Expended to seventy four pounds of tobo and for those Costs and Charges to One pound of tobo And whereupon the afd William Ennis by his attorney afd prays the Court that the writt of Inquirie of Damages afd on which the Inquisition above is returned may be quashed for that the return day therein Mentioned is said to be the third tuesday of march then next when in truth it Ought to have been it Ought to have been the third tuesday of August &c Whereupon the premises being by the Court Maturally Considered &c Therefore it is Considered by the Justices ^here^ that the afd William Ennis take nothing by his writt and Inquisition afd but that the Same Writt and Inquisition be quashed amoved and held for Nothing &c Somersett County fs Know all men by these presents that we Charles Ratcklieff W.m Fausitt and Nathaniell Whaley all of somrsett County in the province afd are holden & firmly bound unto Edward racklieff & Comfort rackliff orphans of Nath.l racklieff dec.d in y.e full and Just Sum of one hundred and Eighty four pounds ten Shill.s & seven pence three farthings Curr mony to be paid unto the s.d Edward and Comfort racklieff orphans afd their heirs Ex.rs adm.rs or assignes to which paym.t well and truly to be made and don we bind our selves our & Either of our heirs Ex.rs adm.rs for the whole and in the whole Joyntly and severally firmly by these presents sealed with our seal and Dated this 17.th day of aug.t Anno Dom 1726 The Condition of the above Obligation is Such that if the above bound Charles racklieff W.m Fausitt and Nath.ll Whaley their and Either of their heirs Ex.rs or Adm.rs do well & truly pay or Caused to be paid unto the above s.d Edward and Comfort racklieff their heirs Ex.rs admrs or (assignes) |
