176 Death hath paid or Either of them for it in anywise Contented altho the same Charles afterwards in his life time to witt y.e same day and year afd at y.e County afd within y.e afd Jur by y.e s.d Nathaniel in his Life time & the same Benj.a and Mary since the death of y.e same Charles to witt y.e tenth day of May Anno Dom one thousand seven hundred and and twenty four at y.e County afd within y.e afd Jurisdiction by y.e same W.m since y.e Death of y.e same Nathaniel and the Espowsalls between y.e same Benj.a & Mary Celabrated was thereto requested but they and Every of them the same hither to to pay have altogether refused & still doth refuse whereby the same W.m says he is wors and Dam to the value of three thousand pd.s of tob.o & thereof he brings this suite &.c and the same W.m Brings hereinto Court the Letters testamentary &c by which &.c L Gale P Quer pledges &c J Doe R Roe
attorney Come and Defend the force and Injury when &.c And pray Leave to Imparle hereunto untill next Court and they have it and the same Day is given to y.e afd Plft also &c Att which said next Court to witt the Sixteenth day of Novem Ann.o Dom one thousand seven hundred and twenty five Came again as well the afd William Ennis Ex.r as afd as the afd Benjamin Tull and Mary his wife Exrx as afd by their attorneys afd and the said Benj.a Tull and Mary his wife ^by their said attorney^ pray further Leave to Imparle hereunto untill the Next Court and they have it and the same day is given to the afd Plft also Att which said next Court to witt the fifteenth day of March Anno Dom one thousand Seven hundred and twenty five Came again as well the afd W.m Ennis Ex.r as afd as the afd Benj.a Tull & Mary his wife Exrx as afd by their attorneys afd and the said Benj.a Tull and Mary his wife by their said attry pray further Leave to Imparle hereunto untill the Next Court and they have it & y.e same day is given to y.e afd Plft also Att which said next Court to witt the twenty first day of June anno Dom one thousand seven hundred and twenty Six Came again as well the afd W.m Ennis Ex.r as afd as the afd Benj.a Tull and Mary his wife Exrx as afd by their attorneys afd and the same attorney of the same Benj.a afd Plft in the plea afd to be given nor nothing Else thereof says in bar of the action of the afd Plft by which the Same Plft Remains against the same defts thereof undefended Wherefore the afd William his damages by occasion of the premisses ought to recover but because it is not Known to his Lordship's Justices ^here^ what Damages the afd William hath Sustained ^as well^ by Occasion of the Nonperformance of the promise and assumption afd as for his Cots and Charges by him about his suite in that Part Expended therefore Command is given to the Sherr of Somersett County that by the Oath of honest and Lawfull men of his Bailywick or County he deligently Enquire what Damages the |
