174 Loosing his Life and forfeiting his Chattells Lands & Tenements whereby the same John says he is worse and hath damage to the value of sixty pounds Curr.t mony & thereof he brings this suite &c L Gale P Quer pledges &c J Doe R Roe And the afd Charles Lowe by Joseph Pemberton his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill next Court and he hath it and the same day is given to the afd Plft also Att which said next Court to witt the Sixteenth day of August ann.o Dom One thousand seven hundred and twenty six Comes again as well the afd John Collins as the afd Charles Lowe by their attorneys afd and the Said Charles Lowe in his own proper person Com and says that he Cannot gainsay the action afd of the afd Jno Collins nor Can he Say but that he is guilty of speaking and publishing the words Laid in the plfts decl.n afd and that the same words were falce and feigned and that he had wronged the Same Plft by uttering of the same words &c Wherefore it is Considered that the afd John Collins Recover against the afd Charles Lowe 943 his damages afd as also the sum of Nine hundred and forty three pounds of tobo for his Costs and Charges by him about his suite in that part Expended to the same John by the Court hereof his assent Taxed & the afd Deft in Mercy &c whereupon the afd Plft gratis here in Court Remitteth the afd Deft of all & Singular the damages that might accrew upon the action afd therefore ye same Deft of the same Damages be acquitt &c
Ninth day of May Anno Dom One thousand Seven hundred & twenty Six at Somrsett County afd within ye Jur of this Court one horse of ye value of ten pounds Currant money then & there being ye proper Horse of ye afd Donnock Dennis then & there did Kill & Distroy against the forme of an act of assembly of this province Entituled an act ascertaining ye height of fences to prevent ye Evill Occasioned by ye Multitude of Horsses & restraining Horse rangers within this province & to redress ye Evill accrewing to this province by ye Multiplecity of Useless Horses Mares & Colts that run in ye woods By vertue of which Said act action hath accrewed to ye afd Donnock to have & require of ye afd James ye full value of ye Horse afd ^of^ which the said James afterwards to witt ye day & year afd at ye County afd within ye afd Jur by ye Said Donnock had Notice & then & there was requested to pay unto ye Said Donnock ye full value afd of ye Horse afd Nevertheless ye afd James ye afd Sum of Ten pounds ye value of ye Horse afd or any part thereof to ye Same Donnock hath not paid but ye s.d James ye S.d Donnock in any wise to Satisfie for ye S.d Horse hath altogether refused & Still doth refuse to ye Damage of ye Said Donnock twenty pounds Curr money & thereof he brings this Suite &c L Gale P Quer pledges &c Jn.o Doe Richd Roe And the afd James Steell by George Dashiell his attorney Cometh and defendeth the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the Same day is given to the afd plft also Att which said Next Court to witt the sixteenth day of august anno |
