175 ann.o Dom One thousand Seven hundred and Twenty Six Came again as well the afd Donnock Dennis as the afd James Steell by their attorneys afd and the said James Steell by his said attorney as before defends the force and Injury when &.c and says he is not guilty of the premisses above upon him Imposed in manner and form as the afd Dennock Dennis above against him hath Complained and of this he putts himselfe upon the Country and the Plft in like manner Thereupon Command is given to the Sherr of Somersett County that Immediately he Caus to Come here twelve &.c by whom &.c who neither &.c to recognize &.c becaus as well &.c of which said preceipt the said Sherr to witt Francis Allen Gent Now hereat this day to witt the Same day and year Last mentioned makes return that he hath here ready twelve &.c as by his said Preceipt he was Commanded and now hereafterwards to witt the Same day and year Comes as well the afd plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to wit Robert Mills, Henry Allexander, Thomas Layfeild, William Sasser, Benj.a Fooks, Thomas Pullett, John Fleming Thomas Nathaniell Williams Thomas Bevins, Cannon Winwrights Alexander Carlyle, Isaac Brittingham who being duely Elected tryed and Sworn ^to say the truth in the premisses^ upon their Oath do say that the afd James Steall is guilty of the premisses as the afd Donnock above against him hath declared; and do assess the Damages of the Same Donnock besides his Costs and Charges in this behalfe Laid Out and Expended to four pounds ten Shillings Current money and for those Costs and Charges to one pounds of tobo Therefore it is Considered by the Justice here the Sixteenth day of august anno Dom One thousand seven hundred and twenty six that the afd Donnock Dennis recover against the afd James Steall as well the Sum of four pounds ten Shilling's Curr.t money and One pound of tob.o his damages afd by the Jurors afd assessed as also the Sum of Eight hundred and Eighty Eight pounds of tob.o for his Costs and Charges by him about his Suite in that part Expended to the same Donnock by the Court here of Increase adjudged which Certain Damages in the whole do amount to four pounds ten shillings and Eight hundred and Eighty Nine pounds of tobo and the afd Deft in mercy &c
of this Court was Indebted unto y.e s.d Thomas y.e sum of Eight hundred & thirty four pd.s of tob.o as p.r acc.o here to annext may ^in Court^ appear & being so thereof Indebted as afd for & in Consideration afd at y.e time and place afd did upon himselfe assume & promise that y.e afd sum of Eight hundred & thirty four pounds of tob.o he would pay & Content Nevertheless y.e s.d Benjamin (according) |
