174 of august ann.o Dom One thousand seven hundred and twenty six Came again as well teh afd Francis Lancake as the afd richard Knight by their attorneys afd afd and the afd Francis Lancake then and there his writt afd against the afd Richard Knight did not prosecute with Effect but voluntarily suffered his Suite to be discontinued Therefore afterwards vizt the same day and year afd by discretion of the Justices here were adjudged the Same Richard Knight the 150 Sum of One hundred and fifty pounds of tob.o for his Costs and Charges by him about his defence in that part sustained according to the form of the Statute in Such Case thereof lately made and provided and the afd Francis Lancake in mercy and that the afd Richard Knight have thereof Execution
Divers his predesessors late Kings and Queens of England from the time of his nativity hath hitherto Behaved & govern'd himselfe & of good name fame Creditt and Estimation as well among his Neighbours as all other faithfull Subjects of our s.d Lord ye King by all the time afd hath been Esteemed accounted and Reputed and from all Treasons Burgerys felonys thefts or such like wicked or Base Crime and from the Procureing or ap abetting such Like wickedness or of y.e same in any manner noted or suspected by the whole Course of his Life hitherto free Clear & wholy unsuspected hath abstained remained lived & Continued by reason whereof the s.d John obtained y.e favour and good will not only of his neighbours butr of all other faithfull subjects of our Lord y.e King to whom he was Known nevertheless y.e afd Charles not Ignorant of y.e premises but Envying the Happy Estate and Condition of hte same John & Maliciously Intending not only to ruin the good name fame Creditt & reputation of the same and Bring into Hatred & Contempt amongst his Neighbours but also to Bring y.e s.d Jn.o in manifest danger of Loosing his life the tenth day of June anno Dom one thousand Seven hundred & twenty five at y.e County afd wihtin the Jurisdiction of this Court these falce feigned ^ aprobrious words & Lyes following in presence & hearing of Divers faithfull subjects of our s.d Lord the King did say afirm declare & with a high voice Publish viz.t I (the afd Charles himselfe speaking of & meaning) did see John John Collins (the afd Jn.o speaking of & meaning) Buger amair & I (y.e afd Charles himselfe again speaking of & meaning) by godwill swear it before Judge or Jury whereas in truth the same Jn.o never any treason felony Bugery theft or any such like wicked or Base Crime Ever Committed or perpetrated by reason of y.e speaking publishing & uttering of which falce feigned scandalous & approbrious words and Lyes y.e same Jn.o is not only very much hurt & damnified in his good name fame Creditt & Estimation but is brought tho' Innocent in dainger of (Loosing) |
