172 whom &c who neither &c to recognize &c becaus as well &c of which said preceipt the Said Sherr to witt Francis Allen Gent Now hereat ^this day^ to witt the same day and year Last mentioned makes return that he hath here ready twelve &c as by his said preceipt he was Commanded and now hereafterwards to witt the same day and year Came as well the afd plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt William Handy, Benj.a Tull, William Sasser, Thomas Pullett, John Fleming, Benj.a Fooks, Thomas Bevins, Isaiah Bredall Cannon Winwright, James Mumford, Isaac Brittingham Robert Mills who being duely Elected tryed and sworn to say the truth in the premisses upon their Oath do say that the afd John Tilman did assume upon himselfe in manner and form as the afd John Dennis above against him hath Complained and do assess the damages of the same John Dennis by Occasion of the Non performance of the promise and assumption afd besides his Costs and Charges by him about his Suite in that part Expended to seven pounds Sterr money and for those Costs and Charges to one pounds of tobo afterwards in the Same Court Came as well the afd Plft as the afd Deft in their proper person and prays that the action afd in the plea afd between them may be Entered agreed &c thereupon at the prayer of the partys afd that is Plft and deft the action afd is accordingly Recorded agreed and no Judgmt given on the verdict afd &c
unto y.e same James in the sum of five hundred pounds of tob.o & ten Bushells of shelled Indian Corne as p.r acc.t dated the twenty first day of Aug.t Ann Dom one thousand seven hundred & seventeen under the hands of y.e s.d Phillip may in Court appear & y.e same Phillip being Indebted as afd Did promise that y.e s.d tob.o & Corne he would well & truly pay by y.e tenth day of Oct.r next Ensuing the date of y.e s.d Note under the Penalty of one thousand pounds of tob.o & twenty bushells of Shelled Indian Corne (as P.r y.e same Note may in Court appear) Nevertheless y.e s.d Philip the afd five hundred pounds of tob.o & ten Bushell of Corne nor any part thereof according to the tenner of his said note he hath not paid but y.e same to pay hath Denyed & still doth deny to the Damage of y.e s.d James of one thousand pounds of tob.o & twenty Bushells of Shelled Indian Corne & thereof he Brings suite G Dashiell pro Quer pledges &c J Doe R Roe And the afd Philip Tayler by Levin Gale his attorney Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill Next Court and he hath it and the Same day is given to the afd Plft also Att which said next Court to witt the Twenty first day of June (Anno) |
