170 afd Charles Ennis at the time of his death in their hands to be admrd to ye value of two thousand five hundred pounds of tob.o whereof the said William of y.e Debt afd they Could sattisfie to wit at Somersett County within the Jurisdiction of this Court and this he prays may be Enquired of by the Cuntry and the afd Deft.s in Like Manner Thereupon Command is given to the Sherr of Somersett County that Immediately he Caus to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said Preceipt the Said the Said Sherr to witt Francis Allen Gent Now hereat to witt the Sixteenth day of August Anno Dom One thousand Seven hundred and twenty six afd makes return that he hath here Ready twelve &c as by his said preceipt he was Commanded and Now hereafterwards to witt the Same day and year Came as well the afd Plft as the afd Defts by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt William Handy, William Sasser, Benj.a Fooks, John Tilman, Isaiah Bredall, Cannon Winright, James Mumford, Isaac Brittingham, Robert Miles William Robinson, Marcy Fountain, John Fleming, who being duly Elected tryed and Sworn to say the truth in the premisses upon their Oath do say that the afd Benjamin Tull and Mary his wife on the fifteenth day of June anno Dom One thousand seven hundred and twenty five had divers goods and Chattells which were of the afd Charles Ennis at the time of his death remaining in their hands to be adminstred to the value of Nine hundred and Sixty Nine pence and do assess the damages of of the Same William Ennis by Occasion of the Non performance of the promise and assumption afd besides his Costs and Charges by him about his Suite in that part Expended to Nine hundred and Sixty ^Nine^ pence and for those Costs and Charges to one pounds of tob.o Therefore it is Considered by the Justices here the Sixteenth day of November ann.o Dom One thousand seven hundred and twenty six that the afd William Ennis recover against the afd Benj,a Tull and Mary his wife Exrx of the same Charles Ennis as well the Sum of Nine hundred and Sixty Nine pence and one pound of tobo his damages afd by the Jurors afd in form afd assessed as also the sum of Six hundred & Sixty One pounds of tob.o for his Costs and Charges to the same William by the Court here of his assent of Increas adjudged which Certain damages in the whole do amount to Nine hundred and Sixty Nine pence & seven hundred & sixty three pd.s of tobo to be Levied of the goods and Chattells which were of the afd Charles Ennis in the hands of the afd Benjamin Tull and Mary his wife Exrx as afd remaining to be administerd if so much in their hands they have and if so much in their hands they have not then the afd sum of Nine hundred & sixty Nine pence & seven hundred & sixty three pds of tobacco to be Levied of the proper good & Chattells of the afd Benjamin and Mary and the afd Defts in Mercy &c
the King that Now is & as a good true & faithfull Subject of our s.d Lord the King & divers his Predesessors Late Kings & Queens of England from the time of his Nativity hath hitherto (behaved) |
