And the afd Benjamin Tull and Mary his wife Exrx as afd by George Dashiell their attorney Come and defend the force and Injury when &c and pray Leave to Imparle hereunto until Next Court and they have it and the Same day is givent to the afd plft also Att which said Next Court to witt the Sixteenth day of Novem Anno Dom One thousand Seven hundred and twenty five Come again as well the afd William Ennis as the afd Benjamin Tull and mary his wife by their attorneys afd and thereupon the said Benjamin Tull and Mary his wife ^by their said attorney^ pray further Leave ^to^ of Imparlling hereunto untill the Next Court and they have it and the Same day is given to the afd plft also &c Att which Said next Court to witt the fifteenth day of March anno Dom one thousand Seven hundred & twenty five Came again as well the afd William Ennis as ye afd Benjamin Tull & Mary his wife by there attorneys afd & there upon ye said Benjamin Tull & Mary his wife by there said attorneys pray further Leave to Imparle hereunto untill the Next Court & they have it & the Same day is given to ye afd plft also &c Att which Said Next Court to witt ye twenty first day of June anno Dom one thousand seven hundred & twenty Six Came again as well ye afd William Ennis as ye afd Benja Tull & Mary his wife by there attorneys afd & thereupon ye Said Benj.a Tull & Mary his wife by there said attorneys pray further Leave to Imparle hereunto untill ye Next Court & they have it & ye Same day is given to ye afd plft also &c Att which said next Court to witt the Sixteenth day of August Anno Dom One thousand seven hundred adn twenty Six Came again as well the afd William Ennis as the afd Benjamin Tull by and Mary his wife by their attorneys afd and thereupon the said Benjamin Tull and Mary his wife by their said attorney as before defends the force and Injury when &c and Saith that the afd W.m his Action afd against him ye s.d Benja & Mary as afd to have & mantain ought not because he saith that they ye s.d Benj.a & Mary at y.e day of y.e Impetration of ye originall writt of him y.e s.d W.m had fully administred all the goods & Chattells which were of y.e afd Charles Ennis at y.e time of his Death in his hands to be administred by reason whereof y.e afd Benj.a& Mary the Debt afd to the afd W.m they Could not pay & this he is Ready to verifie wherefore he prays Judgm.t of y.e s.d W.m his action afd against him to have ought And y.e afd W.m saith that he by any thing in y.e s.d Benjamins plea alledged ought not to be barred because he saith that y.e s.d Benjamin & Mary have & at the time of y.e suing out of y.e originall writt to witt on y.e fifteenth day of June Anno Dom one thousand seven hundred & twenty five had Divers goods & Chattells w.ch were of y.e (afores.d) |
