                     Benjamin Tull late of Somersett County planter and Mary his
wife Exrx of the Last will and testament of Charles Ennis Late of Somersett
County dec.d was attached to answer unto William Ennis of a plea of trespass
                                     upon the Case &c             And whereupon the Same William by Levin Gale his attorney
       Complains that whereas the afd Charles in his lifetime the tenth day of may one thousand seven
       hundred and twenty at Somersett County afd within the Jurisdiction of this Court was Indebted
       unto the Same William in the Sum of two thousand four hundred and forty one pounds of tobo
       as by Acc.o here within Court produced may appear & so thereof being Indebted the sd Charles in
       his Lifetime afterwards to witt the same day & year afd at the County afd within y.e afd Jur
       in Consideration thereof upon himselfe assumed & to ye same W.m then & there faithfully promised
       that he when afterwards he should be thereto required he the afd Sum of two thousand four
       hundred & forty one pounds of tob.o to y.e Same W.m would well & faithfully Content & pay
       Nevertheless yes.d Charles in his Life time & yes.d Mary since his death whilst she was
       sole & y.e afd Benj.a & Mary since the Espousall between them Celabrated since the
       death of yes.d Charles the promise & assumption of the s.d Charles in his Life time so as afd
       Made Little Regarding and Plotting & fraudulently Intending ye same W.m in this part
       to Defraud & Deceive Neither y.e afd Charles in his Life time nor the afd Mary Exrx as
       afd since the Death of the s.d Charles whilst she was Sole nor the s.d Benj.a & Mary since
       the Espousalls Between them Celabrated the said sum of two thousand four hundred and
       forty one pounds of tob.o or any part thereof to the same W.m paid or him for it in anywise
       Contented altho's yesd Charles in his Life time afterwards to witt y.e day & year afd & y.e afd Benj.a
       & Mary since the death of y.e same Charles & the Espousalls between them Celabrated to witt the
       tenth day of May Anno Dom one thousand seven hundred & twenty four at y.e County afd within
       the Jurisdiction afd by y.e same W.m was thereto requested but they Every of them the same
       hitherto to do have altogether Refused and ^still^ do Refuse whereby the same W.m says
       he is wors & hath Damage to the value of five thousand pd.s of tobo & thereof he bring
