       August Court                1726            169

       by the Justices here the sixteenth day of august one thousand Seven hundred and twenty
       Six that the afd Thomas Dashiell Recover against the afd William Robinson the Sum of
       seven hundred and fifty seven pounds of tob.o his damages afd in form afd Confesed as also the
(310)   sum of three hundred and Ten                              pounds of tob.o for his Costs and Charges
       by him about his Suite in that part Expended to the Same Thomas by the Court hereof his
       assent adjudged &c and the afd deft in Mercy &c

planter al.s Dict Daniel Sharradon of ye County afd Planter was
sumoned to answer unto Mary Martin Exrx of the Last will &
testament of rob.t Martin dec.d of a plea that he render unto her one
       thousand four hundred & four pounds of tob.o which from her he unjustly Detains &c

             And whereupon the same Mary by Levin Gale her attry Complains y.t whereas
       the afd Daniel the twenty Eighth day of July Anno Dom one thousand seven hundred & twenty
       four at somrsett County afd within the Jurisdiction of this Court by his Certain writing obligatory
       which the same Mary signed with the seal of the same Daniel hereinto Court brings granted
       himselfe to be held & firmly bound unto y.e afd rob.t in his Life time in ye sum of one
       thousand four hundred and four pounds of tob.o to be paid the same rob.t his Ex.rs adm.rs or
       assignes when afterwards the s.d Daniel Should be thereto requested yet y.e afd Daniel tho'
       often thereto required the afd sum of one thousand four hundred & four pounds of tob.o to the afd
       robert in his Life time nor the afd Mary since his death hath not rendred but ye same
       Daniel the same hitherto to do hath altogether Denyed and still doth Deny to the damage
       of the same Mary three thousand pounds of tob.o & thereof she brings this Suite &c
       and the same Mary brings hereinto Court the Letters testamentary &c by which &c
                                                                                        L Gale P Quer pledges &c J Doe R Roe

                And Whereupon the afd Daniel Sharradon in his proper person Cometh & defendeth
       the force & Injury when &c    And Saith that he Cannot Gain Say the action afd
       of the afd Mary Martin Exrx as afd nor but that he ^Detaineth from^ oweth the afd Mary the afd one thousand
       and four hundred & four pounds of tob.o p in Manner & form as the same Mary above ag.t
       him Complained               Therefore it is Considered by the Justices here the sixteenth
       day of august Ann Dom one thousand Seven hundred & twenty six that y.e afd Mary Martin
       Exrx of the same Robert Martin recover against the afd Daniel Sharradon as well the sum
       of one thousand four hundred & four pounds of tobo her Debt afd as also y.e Sum of
212   Two hundred & Twelve               pounds of tob.o for her Damages which she sustained
       as well by occasion of the Detaining of y.e same Debt as for her Costs & Charges by
       her about her Suite in that part Expended th to the Same Mary by the Court here
       of her assent adjudged &c and the afd Deft in Mercy &c
